No. If a vehicle is being driven erratically, knowing the reason behind the erratic behavior helps to better predict how that driver might respond (or fail to respond) to any potential scenario.

For example, are they lost & trying to read a map? Drunk? Sending a text? Searching for a radio station? Falling asleep? Etc...

Some problems are temporary, and as soon as the driver pulls his head back out of his rear end, the vehicle will stop behaving erratically. Other problems are more serious, and may require LEO or EMS response. Some problems can be solved by making contact over the CB. Then there are problems that you just want to back off and keep your distance, while others you may be better off passing them and getting on up the road.

...but you've got to know what's wrong before you can decide what to do.

Yeah, I love those guys with the full size road atlas covering the entire steering wheel. I think of them whenever someone complains about gps, smart phones, or any of the other tech that they always complain about.

Gonna have to go to the eye doctor. My eyes don't focus from the road quick enough to see the GPS while I'm trying to program it...or the smart phone when I'm surfing the net.

I've been putting that off for a while. Lucky my brother works for a high end eyeglasses shop.

I've never had a driver walk away as soon as I stop them that was driving a truck. I had plenty of pursuits and bailouts as a road patrol. In that case they are arrested and charged with fleeing. It would be the same in a big truck. I've had quite a few truck driver's walk away from the truck after I was done with them. Only one brought me the keys though and said I quit. If one tried to walk off while the stop was still going on, he's getting at least detained in handcuffs and probably charged with fleeing or eluding. There are other charges that relate to refusal to be weighed or refusal to be inspected. Each with hefty fines. Never had a driver do that yet either, but I guess any day could be the day.

I am not DB, but I will tell you that it has happened several times to me over the years.

Drivers have quit on the spot, been fired by the company on the spot. Drivers have walked away, sneaked away and ran away.

Every driver is expected to stick around and face the music for whatever has occurred here. If he wants to quit and walk afterward, his choice.

What did you do to the driver that brought you the keys and said I quit?

Was there also an additional citation or arrest made?

Obviously, if you flee before the citation is written it's fleeing.

Also, I guess it may depend on what the driver is hauling. Say a driver hauling Haz-Mat is pulled over, you write him a citation... Once you hand him the ticket and say your free to leave... Driver hands you the keys and says I'm done.

In this scenario, the driver would be causing you to break Federal law if you allow him to leave, as you don't have authority to take possession of a HazMat load(unless something has changed recently).
