    If the driver was found to be speeding, then the judge will take that into account and so be it. Most of the roads in that part of Florida typically have a 55 mile an hour speed limit.

    even farm roads..?? you got proof of that..??

    do you know THAT ROAD...?? can you google earth the road and get us a pic,,of a speed limit sign..??

    ok, so even IF the speed limit was 55...and the drivers were doing 60...what does that mean..by the law..??

    SPEEDING...!!!!

    No he isn't. You are making it about the horse. He and i are talking about the consequences of operating a truck like some hobby instead of a business.

    Yes in a perfect world the owner of the horse should be held responsible IF it can be proven he was negligent. But in the real world it doesn't work that way. He will pay some piddly amount in a fine, and at worse his credit will take a hit for the next 7 years after a judgement is finally awarded. In the mean time this driver is financially ruined and possibly homeless. All because he chose to run on a shoe string budget and wouldn't spend the 200 bucks a month for occ/acc.

    As i said in an earlier post, it now appears there was negligence, but the consequences for the owner are going to be practically a slap on the wrist. He isn't going to lose his farm and he won't be doing jail time. If he has other animals he will be pestered to repair his fence, and face some piddly wink fine.

    Route 33(where the accident occurred)is a STATE HIGHWAY.

    ok..so going over the speed limit, is NOT speeding.>??

    it won't take much for the measurements to confirm (or deny) speeding by one or both drivers. defense counsel for the farmer can (and will) argue that had the no-insurance trucker had NOT been going over the speed limit, he would have NOT been that close to the horse flying thru the air....and most likely, the horse would have fallen in front of his bumper, instead of into his windshield.

    We don’t know yet how fast the truck was going when the horse hit it. Right now I’m trying to find the posted speed limit for Route 33 on Google street view. But usually rural highways in that part of Florida have a 55 mph posted speed.

    i just tried as well, went way past R+L carriers on the left, then beyond. that, another trucking company, ....no speed limit signs
