but if that wouldve been a cop, who went inside to the donut shop and someone tried to steal his car in the process, with multiple weapons inside his car and he took the same action this civilian did. he would be seen as a hero and would never even thought to be charged with murder.

this must be the follow up to this story many weeks ago. the guy at the warehouse..
it is NOT a carjacking if YOU ARE NOT IN THE CAR.. it is stealing. and further, you cannot shoot someone fleeing.
that criminal MUST be coming at you face to face. he shot the guy thru the side window..... not face on face. his life was not in danger at that point.
this is murder.
cops got it right. -
I disagree. It has been documented and argued in court many times that even a fleeing suspect can still pose a life threating risk.

The story said the theif was driving the car towards the owner which is when the owner opened fire.. Regardless he may be charged with murder but they will have to prove to the jury that he is a murderer. Which is going to be a hard taskdrvrtech77 and Boondock Thank this.

well i'll have to see it for myself to believe that. we were told in CCW class, taught by an attorney in fact, knowing of the laws.... that, YOU DO NOT SHOOT at a fleeing person. he's getting away, your life is no longer in danger. as it stands now, the dead thief will not have any attorney to argue his case, now will he? and the police are the only ones that can shoot a fleeing suspect. not an individual. no matter his being an instructor or not. he's NOT a LEO.
yes, driving towards him, but yet, not shooting at the windshield, but the drivers side window??
that tells me, he got out of harms way. he was no longer in any danger. instead, he made a dangerous decision to shoot.
a good prosecutor hungry at election time, will show the owner of the car was shooting when he should have not been, in effect killing that thief maybe with "killing with extreme prejudice"
To kill someone without hesitation, mercy, or discernment.
i cannot see the charges being reduced, or even dropped.
and this debate continues, like the last time.
