here's the rub about self defense and shooting.
one must be in danger of death, in this particular situation, YES, the thief drove towards the victim..however, the victim did not shoot the thief thru the windshield, but thru the drivers side window..meaning, the victim moved out of the way, out of harms way, he was no longer in imminent danger.
this from a Nevada criminal attorney
so, since the victim got out of the way of the vehicle, where was the imminent danger to his life?

and again, the police report even suggests he MOVED out of harms way, please re-read...

Just my opinion, but, shooter was in the right. Morally. In a justice system, there would be no charges brought. However, we don't live under a justice system, we live under a legal system. Two entirely different things.

I was wondering when that elephant was going to be mentioned......the shooter set himself up for that one. I'm guessing he's going to do time because he opened the door to a situation that didn't need to be opened. How can a firearm instructor be that reckless to have so many weapons and to leave his car unlocked with the keys in it?
