Legally Have a Couple Beers?

    my company policy is no alcohol within 8 hours of getting behind the wheel and most truck stops its no alcohol consumption on the premisis so with a 10 hour break its not worth it to have a couple since i sleep the middle 8 (hour to take care of paperwork on both ends of my 8 hours of sleep) i just drink my turkey for lunch when i get home off the road

    I don't disagree with the message intended from your post, however, the lower BAC levels only applies to when you are operating a CMV. If you are in your 4 wheeler and get stopped for DUI, your BAC limit is whatever that state has set, not lower. I made the mistake of getting a DUI in my personal vehicle and know this to be a fact.

    To make this a little more clear, your BAC level in a CMV cannot be more than half the legal limit of that state. In your personal vehicle, it's no different.

    Again.....there is NO FEDERAL LAW that restricts the possession of a LEGAL weapon in a CMV.

    ya, I wish half the time I am home that someone would come and put ME Out of Service for 24 hours.

    I do not think he was talking about home in the "figurative" sense, I don't even know what a figurative home is,
    So, the literal interpretation must be used.

    Just so I am clear on this.

    If someone has even a small trace of alcohol in their system while operating a CMV they can be shut down for 24 hours? In order to be arrested for DUI in a CMV you must have at least one-half of the state allowed limit?
    Correct, or incorrect? Thanks........

    Just to throw a monkey wrench into things, that someone may not think about....

    Mouthwash! Use those with no alcohol. Trace amount is exactly that, trace! Anyone look at the alcohol content in listerine, and even those that do not "burn" when used?

    So for safety sakes, get mouthwash with no alcohol, as I'm sure the DoT has heard it all and will still shut you down for 24 hours due to a trace from mouthwash!
