Less than 2 weeks driving and I'm already into it with the Safety Dept.

    Aargh.

    I got called in to the office for a ruler to the knuckles today.

    Two strikes -

    1) Backing over an obstacle on a vendor's property.
    2) Not reporting the incident to the vender or the company.

    It wasn't me! :biggrin_2551:

    I slip seat between three trucks and I share them with 5 other drivers. I was shown a security cam video clip which was time and date stamped. The video shows one of our trucks pulling into a yard at an awkward angle and having to back up to straighten out. The are reflector poles on either side of the entrance to mark it for snow plows. The truck struck one of the poles when backing and bent it. The driver then pulled forward and went on to the gate without getting out to look.

    Since hiring on, I've only been sent to that vendor twice. I am usually sent to one farther away from the yard when my shift starts. Yes, that is one of the trucks I've driven. However, the truck number doesn't match the truck I drove that day. I use an app on my phone called Big Road. Each day I drive, it logs my truck numbers, odometer, stops, miles and hours. I mainly do it for my own reference, but now I want to use it as evidence I wasn't on the property that day.

    What is the best way to appeal a reprimand from Safety? Would the company accept the information from the Big Road app or am I screwed? Do I have the right to request truck, dispatch and shift assignment records from management so I can clear my case? I have what I have on my phone, but having it on paper from Dispatch or my DM would be even better.

    Three trucks it shouldn't be hard to figure out who was driving that truck that day. 2 weren't driving which leaves 1 innocent driver and 1 guilty driver. Find the guilty driver and have a friendly chat with him.

    We can arrange a line up in front of the guards. :)

    Not saying you did but if you really did do it you need to man up.

    They have a copy of your logbook ? Should show what unit you were driving.

    Actually, all those trucks were moving. They're driving both in the AM and PM shifts. So, three drivers were on.

    Unfortunately safety can do anything they want and the longer you drive ,you're going to see there is no such thing as innocent till proven guilty.If you're sure it wasn't you that did the damage then don't sign anything.Although it could cost you your job which then you apply for unemployment.I've had a few incidents where safety turned it around and made it out to be my fault not with the company im at now but in the past.

    Get your log.....know where you were. Video has a time stamp whether you see it or not . If they're wrong then grind them up and make 'em squirm like pups on a chain., or cut yourself a large piece of humble pie.

    Fess up or smoke their arse for accusing you but take no prisoners either way.

    Take this head on and don't delay. If I were in your shoes then make a written response, complete with your phone App printout (if you can print it out) or at least a picture of your phone showing which unit and trailer you were hooked to on that day. Then it will be up to Safety to ask your DM to provide evidence to confirm or refute your claim. It might be a good idea to "cc" (carbon copy) the memo to a lawyer to let them know that you are ready and willing to take this to the next level if necessary.

    In your memo you should also request a written response from Safety in a timely manner.

    If you don't receive a reply in a timely manner then go to that lawyer that you cc'ed and have him or her draft a request for response and a formal confirmation that you have been cleared. If you pay a couple hundred bucks for a lawyer's time that will be money well spent.

    Always protect your record.

    Edited to add:

    It would be a good idea to take the time to put all the information in your phone App into an Excel spreadsheet and print it out, showing each unit and trailer you used on each date. This way it will let the company know you are tracking this information and they need to be able to also track the information accurately.

    What about your pre trip sheet that you fill out at start of every shift that has the truck number, miles, date if the truck had anything wrong etc. since video is time date stamped that would verify you weren't in that truck that day. Matter of fact since a copy of that is turned in at office daily and book stays in truck (usually) they shoulda already verified who driver was. Why do they assume its you, cause your new and the others are gutless covering their butt.

    The innocent don't run. Stand your ground and defend youself. Sounds like you have ample proof it wasn't you. Lots of good advice from the others here. I am fearless when falsely accused of something by a trucking company or customer. Has served me well over the years.
