Good advice, I have done that before myself. But you need to make sure they will take the load back.

first document everything, pictures, who the driver talked to and so on. Keep the documentation going until it is resolved and you get paid,
second contact the broker and sent them all the documentation then tell the broker they have x amount if time to get this resolved or it goes back to the shipper. Do not take it off the truck and stick it into storage, only remove allow it from the truck by the receiver or shipper or by the orders of the broker in written form.
collecting for the load may be an issue.
this is one of very few issues which the FMCSA needs to change the regulations to force the consignee that if the shipper seals the load, the shipper is liable for the condition of the load barring any external forces (accident) and the carrier and driver is immune from this crap and the receiver has to take the load of the carrier has to compensate for the cost of returning that load and any loses.rollin coal and Trini2019 Thank this. -
Update: My insurance sent a guy out to inspect the load. There was absolutely no damage to any of the products. He said right away too that it was because of the wrapping and loading of the the pallets at the shipper. My driver drove to a dock and re-stacked and re-wrapped the pallets. The guy helped us to contact the receiver and made a new appt. Receiver accepted the load this morning. Thanks for all the advice given here, I appreciate it.

I actually got to deal with a similar situation in Denver last month. Albertsons rejected 6 pallets of salsa claiming their tattle tale temp recorder said the temperature never got below 40 degrees. I made 3 other deliveries from the same load, with temp recorders as well with no refusals. I got a temp download from Carrier proving what I already knew as well, considering I have 2 separate wireless temp sensors of my own in the trailer. It's my trailer, I own it. I knew very well the temp stayed cold the whole trip except for when doors were open at other deliveries. The load was from southern California so returning it wasn't very sensible.
The broker was great but Albertsons was dragging their feet deciding what to do with the product. They took 2 days to determine they wanted to destroy it.
I called Ooida to get some input and they told me to never sit with a load like that. They have what they call a "warehousemens form" you can get from them and you can find a place to store the product until they finally make up their mind. I delivered it to a separate warehouse that agreed to "destroy" it..
Luckily, the broker was very sympathetic and generous and paid me nicely for the 2 days as well as a redelivery fee. I also got a lot of really good salsa to take home...Last edited: Aug 30, 2021
