So I work for a local distributor and about two months ago I was wheeling in a stack of merchandise into a gas station and as I was going through the door, the door hit my dolly and cracked the glass.. So today I get back to the warehouse and I have a pay roll deduction waiting on me for the total for $250. They said it was for the door. Insurance paid half and the company paid a check of 498.23 and I was billed $250..
must i pay this or can i fight it? I haven't signed the form yet.

Id pay it they have you either way if you would have had something or someone hold the door it would not have closed on youre dolly if you fight the cost of the door they will let you go and deduct the cost from youre last check

If he/she didn't sign anything allowing deductions for damage they couldn't withhold any monies from his check.

I had a similar circumstance , years ago , a gate latch came loose at a stop , it was on my blind side while the cab was ####ed. when I pulled thru the gate after unloading diesel fuel at this small stop the gate caught my rear fender and bent the gate . The 12 foot gate door had to be replaced , My employer said I needed tp pay $1200 for the gate . I told him that s the cost of business , and you have insurance ! , I refused to pay . My opinion , sh#t happens at times , If its once in a great while and your a good employee then they understand. If they don't understand this then I would work sumplace else . WE do have choices today . your call and decision as to work in your area ,? if you like the Job ? need the job ect.. I wouldn't pay.

Sounds pretty low to me. Usually a company is responsible for ALL damage caused by a driver as the driver is an agent of the company. There's a theory of law called just that, Agency. You have an implied threat here that they will find a reason to cut you loose. What part of the world are you in? California would be good. Has a labor board that would consider it retaliatory if they fire you over this and would probably prevent them from docking you. Sounds like no one talked to you in advance about charging you--are you union, non-union, right-to-work state? Size of company, how long you've been with them and how confident you feel about heading out the door to another, better job.
Thirty some years ago I had a Teamsters trucking job and a terminal manager, hot headed but a softy, a peach. He'd fire me once or twice a year and I always got paid for my time off. One time he chased me out the door after telling me I was fired, ordering me back to work. I said, "Ray, if you can get me a three-day return-to-work notice before I get to my car I'll come back in three (3) days. Otherwise, i'll wait for your certified letter." Your boss, however, may not have the soft-good-heart that mine had. -
The only way they can make you pay is a pre-agreement or a civil suit. They can even ask you nicely to pay and you can say yes. But it illegal to take the money or coerce you into agreeing to pay by threatening you your job.
How far do you want to take it? Refuse to pay, then you get fired and then you have to prove it to the dept of labor. If you can prove it they will be forced to reinstate you with back pay. Then there is the cost of an attorney.
How often does this happen? Do you like your job? Sometimes it's easier to pay. After all it was your fault but it's the company's cost of doing business.
I paid $3000 I didn't have to pay for a company fine. I felt better and didn't have to go find another job. The company gave me more respect. I got a new truck after my incident. -
Now my managers know why when i have an inside residential delivery and the customer says " it goes down in the basement" My answer is it can go any where YOU PUT IT. I dont see my self paying to repair some one's dry wall after i fall and my 2 wheel cart puts a hole in the wall.

i never got my last paycheck from my first otr job. years ago.
due to arguing with the worlds biggest PITA co driver. i hit a pole pulling into the fuel island. $500 for road call, rim and tire.
