Is it possible to run a totally legal log and make a paycheck? So far I haven't figured out how. With all the sitting that I am doing I have to either turn down loads cause I am out of hours or figure out a way to make it look legal. My book is always legal but I am losing out on a lot of money due to sitting cause I don't get paid to sit. The worst case I have had so far was going to a grocery dc to unload and since it took 6 hrs to unload I couldn't take the load on my preplan because I would have run out of hours. I then got stuck sitting for 2 days because there were no other loads coming out of there. Really frustrated being new and my dispatcher doesn't like it when I say I am out of hours after only driving 3hrs.

You should be logging Off-Duty or Sleeper Berth (whichever is more appropriate at the time) when you are sitting and being unloaded. It is perfectly legal to do so, however you may need to a letter from your carrier stating your authority to do this (and keep a copy in your truck if questioned at inspection).

But unless he gets at least 8 hours sleeper it still goes against his 14 hours . But not getting paid to sit ? Decent carriers allow 2 hours loading or unloading then they start paying detention time .

isn't it 8 hours these days?
detention, ahh yes here it is that way.
USA wouldn't pay any accessorial pay if you got more than 2500 in that week. (which was 99.9% of the time)

    Thanks , that was a typo .
But while I'm back I never did answer his question about logging legally and making money . My carrier and many others audit every log of every driver and you better be legal . Do I make money ? I sure do because I am paid detention time and guaranteed a minimum of $.40 a mile every mile I run including deadhead and bobtail . I run dedicated so all empties go right back to the terminal . All my waiting is done at home . So can it be done ? Yes . What are the odds a newbie will get these working conditions ? Very slim .

    panhandlepat Thanks this.

I've been running legal for 17yrs and making money doing it. you just need to do 3 things

1: Work for a good company that pays detention after 2 hrs. These companies arren't just going to take that kind of loss and will get ahold of the shipper/reciever and raise hell.

2: make sure they pay you for layovers. any company that won't is a company to stay away from

3: Tell your disp. that you don't like sitting either. You would rather be running. So he needs to do his job and get on crs to get you the heck out of there.

It seems there's always a way to log to get your full 11. The obvious ways to get you all have to do with distance and toll and scale records.

Logging to get more than the 11 is where the risk is, unless you're backtracking over the same area to do it.

it was. back when there was still freight available. I always ran legal and made a decent income. but now you can't make money no matter what you do because, well, as I said - no freight. but what are you proposing to do? stay up 24/7? never sleep? good luck with that.
