Logging for trip if I have been 100 mile exclusion

    I understand your post and you are incorrect, here is the cut and pasted guideance form 49 CFR Part 395...

    Question 13: What documentation must a driver claiming the 100-air-mile radius exemption (§395.1(e)) have in his/her possession?

    Guidance: None.

    Can't be any simpler 'cept the driver has to remind the DOT officer that he is an exempt driver...that's how you avoid tickets for 'no RODS' when you don;t need one!

    I guess we don't have a meeting of the minds here. "Question 13, What documentation etc". Answer; NONE. Well, that's right until he does a run that requires him to leave his 100 mi radius, THEN, he needs a log book, for that day as well as the previous 8. (showing he was local).

    If you are a local driver, normally operating inside of a 100 air mile radius, starting and stopping each day at the same location within 12 hours, and your carrier maintains a record of the hours you work, you are exempt from having to keep a log book.

    If you do not finish your day at the same location which you began, you do not qualify for the exemption and you must fill out a log book page for that day.

    If you happen to work longer than 12 hours, you need to fill out a log book page for that 1 single day that you are working on. You do not have to have your previous 7 days with you...only the current day.

    If you happen to go beyond the 100 air mile radius, again, you only need to fill out a log book page for that 1 single day that you are working on. You do not have to have the previous 7 days with you...only the current day.

    The reason? Those previous 7 days you were local, operating inside of the 100 air mile radius, and therefore EXEMPT from having to fill out a log book for those days. You do not need to have them in the truck with you. If you are a local driver, you do not even have to start the current day's log book page until you reach the 12th hour, the 100th air mile, or you complete your day in a different location than you started. As soon as you do any of those things, you must fill out the day's log book page to the best of your ability in order to accurately reflect the day's activities up to your last change of duty status. You do not have to fill out pages for the previous 7, or have any other notations indicating how many hours were worked on those days...you ONLY need the current day's log book page.

    Again, run local all week, then on Friday take a run that leaves the 100 air mile radius, and the ONLY day you need filled out in the log book is Friday.
