Logging off duty when in sleeper. Yes or no?

It doesn't matter if it's from those days or not. Fact is DOT is enforcing it because e-logs have cut their log violations and they have to justify their jobs by writing violations. Like I said. The DOT Nazi pulled out a 3 inch thick book, opened it right to the page and showed me the exact wording as the guidance Johan posted. So they ARE stil using it. So basically, log it they way DOT will like it. Don't offer information that can incriminate you and truck safe. My original post has been answered. It's NOT in the regulations, but it IS in the guidance, plain and simple.

Kinda reaching there aren't ya? Do you really think THIS guidance is irrelevant today for some reason?
It's pretty straight forward:
What circumstances have changed to make you think this guidance is no longer relevant?
I don't like that guidance BS any more then the next guy. I can't even find that Q & A silliness in my green book. Seems to me they could easily write that guidance into the actual regulations and put this to rest. But that being said, No reasonable person would say you can legally log sleeper as off duty after reading the guidance. -
Ok, the horse is dead already.
I seriously doubt if the violation in question even took place. Sleeper Berth and Off Duty as far as a NON-SPLIT are virtually one in the same.
If Im in the bunk going down the highway is one situation, as far as parked its quite another. I have also logged Off Duty aat truckstops for strught periods of 10 or more hours and never been questioned about. Im not getting out my logbook cause I have to tinkle, get real.
You have the right to remain slient, something most driver can not do, and should pratice more. Do not feed the guy with the ticket book, Yogi make bite you. -
I am saying they are what is currently published by the FMCSA.
