and if the guy logged off duty and was swiping his atm card and up at the casino, then it wouldn't be a falsification , totally stupid ,but still legal.
that's the real point, whether someone logs sleeper and off duty every time he goes to pee , logs a continuous sleeper berth, or logs a continuous 10 hours off duty will not change one bit how much rest someone actually gets.
whether its paper or elog , the data is entered by the driver, he is the one who switches from sleeper to off duty.
like I have stated I log breaks off duty, but my breaks are not 10 hours on the dot and then up and gone, most time I am parked by 5 to 6 , and not gone until 8. my breaks average 13 to 14 hours. I plan my loads that way, I also stop during the day for a nice lunch, the 30 minute rule doesn't bother me a bit. I rarely do over 2000 miles a week.
I regularly park at night, and a swift , Schneider or other mega carrier will park next to me, you can bet your life that exactly 10 hours after he sets the brakes, he will be gone, whether or not he slept well, goofed off for 8 and slept two.
see the concern shouldn't be is everyone getting up and drawing a line everytime they get up to pee, it should be how the electronic talking box screwed to the dash is running things, with no regard to how the human holding the wheel feels that day.
I see guys all the time who cant even take time to enjoy their meal because they HAVE to max out the driving hours, they HAVE to make that delivery, I HAVE to get 3500 miles in this week. its like a massive video game. someone miles away with the controller telling the characters when, where and how to move .
my point is, whether I log my breaks off duty, sleeper, or draw line every fifteen minutes between the two isn't going to affect how safely I operate that vehicle, what matters is do I actually get any rest, have brains enough to get that rest, and have sense enough to know when I should rest longer, don't feel well, etc and adjust myself accordingly. and a line in a book or on a machine wont change that.

....so if one is on e-logs, and one changes his duty status back and forth between sleeper berth and off-duty faithfully to remain within the letter of the law.....
does that someone move to driving manually prior to moving, or does that one use the cushion that most e-log programs have built into them (driving up to two miles before moving to line 3)?
Personally, I think the distinction between lines 1 and 2 for the purposes of this discussion are idiotic. -

WOW! cant believe this thread is still gone, Can't we all just agree to disagree? if you believe its legal to log off duty while in the sleeper? go for it, If you think it's illegal to do this? then don't, I have talked with FMCSA, And for me? I'll do it so I wont have any issues at the chicken coop
