Looking to sue my former carrier

    Hello. My name is Marcus. Ive recently invested into the trucking industry and bought a 2008 volvo vnl670 in april 2012with the intentions of generating some revenue and grow my business. A really close friend of mine is the operations manager of a small carrier in Conyers, Ga which initially solidified my choice to invest in trucking. I was promised 1.50 per mile driven with .38 per mile going to the drivers that they placed in the trucks. They in turned promised 3000 miles a week, would hire the drivers, and notify me when repairs were necessary. Long story short, my truck has been driven 70k miles and only received revenue for maybe 20k miles. Countless times I was told the truck was down or there were no loads. I finally decided to leave them and take my truck elsewhere only to find excessive mileage that doesnt match my settlements. The settlements never had start or end miles and i dont know if my truck was at those destinations or not and they look so basic like a 3rd graders homework assignment. Ive been contacted by some of their drivers who admitted that they were on the west coast, as im only allowed to go to fhe midwest and east coast per my registration.ALSO, NOT ONE TIME HAS A SETTLEMENT SAID CALIFORNIA OR SEATTLE ON IT!!!! Ive paid 7000 dollars in repairs, and my truck note is 1500 a month. This wouldnt be an issue if I made the money I was promised of the miles thay were driven. Do I have a case? Sorry for the lengthy details.

    Short and simple... NO CASE!!! You did not have anything in writing stating that they was going to give you 3k mi per week. 1.50 is not going to generate enough money for you and the driver. You gave the company full control of your truck. What are your complaints? Just chalk it up as a lost and do some research here. Everything you want to know about trucking is on this forum.

    I was only paid for 20k miles out of the 70k miles driven. The odometer doesnt lie. Drivers have found a way to call me to say that they were in the west coast illegally per the carriers request. To me thats a problem and other truckers ive asked say the miles should add up to the odometer. Shady businesses need to be exposed.

    holy cow. ive heard of the road of broken promises traveled by the trucking industry, but this is a pretty big pothole. i can understand being promised 3k miles and not getting it, my answer would be...oh well, shoulda known better. but if theyve driven your truck 70k miles and youve been paid for 20k...thats theft pure and simple. dont know about the legality, but MORALLY they are bankrupt. your truck could be in the shop for 5 MONTHS, that does not explain away being paid for around 22% of the miles being put on your truck. truck down? miles-ZERO. no loads? miles-ZERO. you need to get the heck out of this bad deal immediately. you may or may not have a lawsuit...ill leave that to smarter men/women than me. but what i do know is you can do a heck of a lot better than dealing with the crooks you are currently with.

    also, i understand your wanting to expose shady business. but leaving the name out of it isnt exposing anything.

    I dont even know the name of their business at this moment as they are changing names AGAIN! My truck is no longer with them. I just want to be compensated for this missing mileage.

    Sorry to tell u this...but welcome to world of a truck owner..they lie to get u in the door..and they lie to u the whole time ur there..chalk it up as a life lesson..move on to the next and try like hell not to make tht mistake again...good luck

    can certainly understand that. rickybobby was right as far as he went. what mileage you were promised, unless its guaranteed in writing...thats on you. but simple math says they stole $56000 from you in unpaid miles. i didnt see your contract, so i dont know what allowances.if any, were made for empty miles, out of route miles, and breakdown miles. if you agreed to hhg miles, that would account for a 5-12% average unpaid miles. but at 20k paid miles, at the high end that only accounts for about 23k total miles. at 70k miles put on the truck, getting paid for less than 62500 miles is downright criminal. dont even get me started about the ripoff of 10% unpaid miles as an acceptable industry standard.

    I understand I cant hold them to miles promised... but 70k miles driven and only 6000 dollars paid is wrong. Not to mention that I have a partner who went on this venture with me in the same boat. I only did my registration for east coast and midwest and I know for a fact my truck was in cali and seattle. None of my settlements have seattle or cali on there.

    Did you have any previous experience in trucking prior too this? I see a lot of people with no experience getting taken. This is not a learn as you go industry for entrepreneurs. Takes years too learn the Ins and outs. Read the fine print of you're contract, it will tell you if you have a case.
