Looking to sue my former carrier

    Here is another thing.. companies don't pay for out of route miles.. and joy riding your driver does... Yeah they hired him.. but he is still your employee at least by websters.. You might ought to check and see if they were withholding his taxes while you are at it.. If you open this can of worms up and have a hickie anywhere they will smear you with it in court.. Plus it is good to know this for next time.. and what you need to do..

    my sentiments exactly, snowwy

    i cant even imagine ANYONE taking my trucking anywhere, not even an mechanic for a test drive, without me knowing it

    i hope he takes care of his wife more than he takes care of that truck

    I've been wondering where the fuel receipts are? Or did the contract have the company paying the fuel and still paying 1.50/mi to the truck minus driver pay? Keeping fuel receipts is a legal requirement for IFTA and IRP, plus log auditing. If they are proper receipts they would be evidence of where the truck had traveled.

    I would still like too know if you have had any previous experience in this industry? I think you posted here before you got the truck didnt you? Saying you wanted a business op? I recall people warning you...

    Ive never posted in here before. I got a tracking system and a perso nal driver to get in touch with and a lawyer to persue this matter off if conmission. Thanks for your replies.

    He probably doesn't know ,he's just trying to figure stuff out. Why he didn't ask for money when it was 5-10k miles over without money, he went without pay for 50,000 miles,,, he didn't care to ask them for a paycheck for that long,,amazing.....

    He really has no case , they can show all kinds of repairs and driver pay and other expenses. The best thing for him to do is sell his truck and take a loss and learn lesson that not to invest in anything without running the show by himself.

    So you never came in between and checked your truck , the condition of you truck...wow...so for probably 7-8 months you never looked at the odometer and one day noticed thats it's 70k more.

    I have a driver in one of my truck , i check even the engine/idle hour on my truck every month and analyze it with the miles driven.
