    Don't worry about it. Some things hurt forever. Time doesn't really matter, because you can't really ever get completely over it - no matter how hard you try. If you had ever experienced something with a family member like she described, you'd realize that.

    You'll be hardpressed, although not out of the realm of possibility, to find 12 people that will put you in jail for that..."Clear and Present Danger" is a state of mind, not necessarily because you're staring down the barrel of a gun and you only need one jurist to see it that way...I'm not a cop, if someone is in my house without my permission, I'm shooting first and asking questions later or waiting to see if the person is armed...

    In this case, the person threw a rock which could have injured or killed the occupant, if that doesn't represent a "clear and present danger", what does?

    First off, yes we probably should let this thread expire, just like the burglar. However I just want to say, that I was a cop for many years. Each state has different laws pertaining to protecting one self, family, and other persons, and property. Texas has a law where you can use deadly force to protect your property, it does not include the apprehension of bodily harm or death.

    Now as far as the statues that I'm real familiar with, Kansas, a person just needs to be able to articulate the apprehension (fear) of bodily harm or death. You don't need to see a weapon, you don't need to have been verbally threatened, and darn sure don't need to wait until someone lunges at you with a knife or points a gun and fires at you.

    So I think that the guy is well within his rights to have used deadly force against the intruder. You ask me, if more people would not be afraid to defend themselves and their property, we might have a lot fewer thieves breaking in, knowing they run a very high risk of being killed.
