Yes but what you sent to the state is still good too. You've followed the law and now you have to follow your emoloyer's policy if you want to continue working there unfortunately.

 

Not on who's approved list? His? If so, I'd say "sure thing! You pay for the physical and YOU pay me for the wasted time." From your post, the company is ok with the Dr. you used. DOT is ok with the Dr. you used. It's only your manager that has his panties in a wad. So he can pay for what he wants.

 

The people paying you can ask almost any legal thing they want.

 

I would say check the online list of approved providers with the FMCSA and make sure he is still on it. If he is, then show it to your manager and see if they can accept it this time and you will use their approved provider next time.

 

Maybe the clinician quit paying your manager a kickback so they are no longer on "his" approved list. I would check with the main company office to see if they still accept this clinician.
