If he returns to Mexico, with the same trailer or one destined for delivery in Mexico. He can use his Mexican CDL. If he intends to LIVE HERE. Then no, its not legal. He will have to get an American CDL. Along with having a Green Card and rights to work here. As to the DOT card, set him up with your Dr. and have at it.

If he has a Mexican CDL and can get a work permit in the US they will let you have a US CDL.

I used to know a guy that did that. He paid a lawyer to do the work for him and I think he has to apply to renew every 1 or 2 years I forgot.

Based and domicile in Mexico; and tractor trailer goes back across to home (Mexico) yes, if intent to live in USA no. Need American CDL etc.

We take Canadian CDL the same way, they go back home. Same as my American CDL going into Canada.

HOWEVER, not all countries licensing are valid to run here in the USA. If you are a tourist and made the mistake of buying a vehicle within the USA, you have to have it registered (Taxes on sale paid) and tagged within 30 days with insurance and a USA based residence.

I know specifically of the case of a member of this forum who holds a foreign licence and was employed by a US carrier. He crossed the border each time to pick up his unit, get loaded, cross the border back and make his deliveries. The US-plated truck was returned to its home terminal at the end of each single or multi-day run.

    Q. May a U. S. carrier employ foreign drivers?

    A. The question of who employs a foreign driver seeking admission as a temporary visitor for
business is one of many factors to consider in evaluating whether the driver may be admitted for
immigration purposes. Such a driver must have an established foreign residence that he or she
does not intend to abandon and must otherwise be admissible. If the truck driver is admitted as a
temporary visitor for business he or she may not engage in point to point hauling within the
United States, irrespective of who employs him.

Their was a special test program couple years ago. The Mexican trucking company and drivers has some special test they had to do and if they passed they could drive in to USA. Only like 6 mexico trucking companiea did that program. Other wise the Mexican truck driver have to stay within 30 miles or something.

Mexico does not or did not a CDL program like USA or Canada. A cop can't verify if the Mexican CDL is even valid from the US. They don't have the computers that share that info.
