Here's the deal. Went down to McDonald's to use wi-fi while there a lady tried squeezing past me and ended up with creased door panels. I was in personal vehicle when this took place. I roll up next to her and ask wtf is wrong with you, at this point she moves her car to try and block me, I glance down at the passenger because he's moving around in a suspicious manner, low and behold he has a gun he is fumbling with, at that point I got the hell out of dodge. Cops show up at my house 15minutes later, they immediately are accusing me of hit and run.knowing this incident took place in a private parking lot I knew all they could do is make a report. Now I didn't yell, curse, or threaten anyone but I was being a bit of a jerk. Anyway officer walks up to me checking for weapons, asks me to turn around (I assume he's just checking still) cop grabs my left arm and slaps cuffs on, now I put my right arm straight down so he can't move it, officer gets upset yelling resisting arrest so I call wife out to video. While being held against a wall I had a muscle spasm in the back which forced my lower body back slightly officer immediately is getting rough and cut his hand on his cuffs. No reason given why I am being cuffed, meanwhile the officer whom was doing the report at McDonald's has arrived. He threw his threats and accusations at me, I tell him I left because of the passenger and his gun. At this point I find out the passenger was gone when they arrived. Officer in charge wants a description of passenger I start saying "you will have to excuse me but" at this point the lead officer says don't you go and say all blacks look alike because he has two mixed kids and they don't look like anybody else. I continue telling him that I was to busy looking at that chrome gun. I give description of clothes then add dude looked like a typical thug. Officer says I bet you wouldn't say that if he was white. I say most certainly would've. Suddenly the officer is angry demanding that I go to jail. Come to find out ol'girl that hit me was the girlfriend of the areas most wanted and guess who the passenger was.
The passenger back in March in cohorts with two others lured a man with the promise of sex to where they were waiting. These people robbed and shot the victim leaving him for dead. Not a thug eh.
So now I am concerned with hiring eligibility.

They did charge me, setting trial date Monday. I feel I was charged because they couldn't get me for anything else.

This is an easy one. Go to court, tell it to the Judge. If you are found not guilty then you have no problem.
You are not asked about arrest, just convictions. -

I don't have any advice for you, but I truly sympathize. I've had similar dealings with police before. Going forward you will be well served to remember that the police are NOT your friend and their typical agenda has nothing to do with law and order or your personal rights. You need to hire a lawyer before you speak to anyone in the police dept or DAs office again.

Shouldn't really hurt and hate it happened that way but I will add this just so you know. Leaving the scene of an accident is a charge here that can be charged on private property. That is one of 5 traffic offenses that can here.

to the o/p, you should really seek legal advice on this, from a real lawyer. try and get the charges dropped, or at least reduced to some piddly crap.let the real lawyers handle this, not truck stop lawyers.

some applications ask, "have you ever been convicted"?
read each application rules CAREFULLY and answer truthfully.

You are going to have a problem on the resisting arrest charge because of that you are guilty. The fact that you shouldn't have been arrested will help but still you are guilty. Get to a lawyer have him postpone and talk to the Prosecutor. The law is not on your side here but a good Prosecutor will dismiss it.
