    Do you have proof of this? If you log off duty for 6, yes the first 3 count, but pretty sure the last 3 count towards your 14.

    Neither rest period counts against your 14. And it doesn’t say you can only have 10 hours total, just that 10 hours total is the minimum.

    Talk bout major confusion for cross border drivers like myself. I like the changes, but will have to diligent to check my cdn hours clock before crossing back to Canada to ensure I’m not in violation. I can see me stopping my 14 clock while in the USA, but that night will have to ensure to take 8 off to make sure I get my cdn hours back too.

    This is where a lot of newer drivers will run into log violation issues.

    As @Long FLD said, according to the new rules neither break counts towards the 14 and that the shorter break must be AT LEAST 2 hours, and the longer break AT LEAST 7 hours totalling AT LEAST 10 hours when added together.

    This was something I was very interested in so I have read everything I could find on it. Then last week I had a conference call with my company compliance guy and a gentleman from the FMCSA to confirm that my understanding was correct.

    I asked this FMCSA guy very specifically about a break using a break longer than 3 hours but shorter than 7 hours as part of the split berth reset. He confirmed that only 3 hours of it counts toward the split reset, but that indeed the entire length of the break was excluded from the 14.

    I too was intensely interested in this change. It appeared to solve my biggest problem with the 14 hour clock.
    My common practice is to start the 14 hour clock, at about hour 7 or so stop for the all important nap( or bicycle ride or whatever). If I do that for 3 hours, then be allowed to extend the 14 hour clock to 17 hours. Then take the usual 10 off and it appears I am totally legal to begin the next day with 11/14. Is that correct?

    I wish they'd do away with the 30 but the change will be helpful at times.

    Extending the clock with at least 2 hours off duty is a major improvement IMO. That I will use a lot.

    From everything I have found reguarding this rule you would be perfectly legal to do as you stated, PROVIDED that at least 7 hours of your normal 10 off is logged as sleeper. If you logged your entire 10 hours off as Off Duty, then the break mid day would count toward your 14 hour clock.

    Now if we could only get the FMSCA to finally admit that compensation should be a direct factor of hos status we’d be ahead of the game. They certainly admit its cause to be logged on duty while doing work and compensated by a non motor carrier employer.
