ok certain details have to be left out primarily location because my wife is a leo for a small town .....they got a call outside of town about a disabled rig ....rig was blowing black smoke and doing about 10 mph ....driver also refused to pull over after about 15 min he stopped and stumbled out of the rig (almost got tazed) needless to say the driver blew a .12 and there was an open bottle of jack by the seat ....dot couldn;t respond but did arange impound of t/t....
now my anger and my wifes was on his record and the companies reaction .....
1st his record 3 convictions for dui one in the last three years and a couple convictions for possession
2nd when she talked to his safety director their first reaction was to write a com check to bail him out
i won;t get too specific but in that town the da sucks and dui is an or once you sober up so lucky him don;t know what charges dot might press since they can without being present ....
but how the hell does this moron still have a cdl i thought there were some safety measures in effect ....beauty of it the carrier had insurance too and it was valid as she verified it too ....i still am in shock it takes me almost eight months too get back on the road with an insulin waiver and this jack ### can still drive with no issues actually i am pissed

Bigdad, I wish it wasnt so but on rare occasions people manage to "slip" through the cracks. 9 times out of 10 it is because the company that particular driver was working for most likely had very shady practices. DOT will most likely (depending on an investigative finding) revoke his CDL as for criminal charges that will most likely be left up to the DA.

that being said i do believe that since i know their insurance is valid i will be taking one for the team and letting them rearend me next chance i get ....man talk about a great lawsuit you jack ###;s hired a guy with three wait now four dui;s and two drug charges man there can;t be any legitimate defense to that

but i thought it was nearly impossible to get a cdl or even insurance with one that recent whether commercial or personal not to mention the drug convictions -

bigdad that is pretty serious. It sounds like the company is turning their head to allow this guy to drive. Private vehicle or not, after the first DUI at minimum he is suppose to complete a Substance Abuse Program before he is allowed in a CMV.
I would bring it to the DOT"S attention and let them intervene if you have the guy's personal info.
Here's where you report him. He definitely doesn't belong behind any wheel. You'd be doing the world a favor.

to try and find something they could use against me the AAG lady had a very old record from bham it said my DL had been suspended 10 times.
The lady handed it to me at deposistion and it said my dl was suspeneded 10 times in ONE day, naturally after I objected she relented due to being
old and inaccurate. I don't put much faith in what a quick computer check will show only when you pull the case file will you know if it's right or not.

no it was his III so these were criminal convictions not dmv records.....not to mention he did blow .12 so i would give it some cred it was forwarded to our states highway patrol so i am pretty sure they will follow up maybe none of the criminal convictions made it to his mvr like you said could be typical gov;t agency non communication

You don't. unless they have a warrant. I have refused before some years back I told them to blow me (never lost my DL either). I never understood how they charged me anyway. My pick up was on other side of building about 200 feet away and they didn't see me drive it. The case went away anyway after I paid out money, it's all a money thing.
