MVR Question

    Hello,

    2 and a half years ago I got a 27mph over in a 55 mph speeding ticket in a neighboring state, Pennsylvania. Today I went to my local Delaware DMV and got a copy of my 5 year MVR, it was completely clean, I was suprised, I was certainly expecting to see my one and only traffic infraction I thought states had a database similar to the NCIC, but for MVRs. I have been waiting close to a year and a half for this ticket to fall off. Is there some hidden federal MVR that isn't accessible to individuals? Am I good to go?!

    It is called the CDLIS. I am surprised it hasn't shown up either. I have to check into this, as I was once sure that when you got a ticket out of state, YOU STILL HAD TO report that to your DMV, with-in x number of days. I'll check, maybe I'm wrong.

    sometimes they fall through the cracks 20 yrs ago i got a ticket in cali never paid it due to the fact when i called they said the ticket was 62.00 3 wks later i got my mo back in the mail with a letter stating since i was in a cmv it would be 762.00 at that time they had no agreament with my home state i wrote back with a big ## stayed out of ca for a few yrs but my first trip back in got stopped at banning for a level 1 sweating thought i was going to jail at they end i passed and told to have a safe trip so yes miracles can happen

    Here is what I found from a California CDL manual...

    Notify their home state Department of Motor
    Vehicles of any conviction which occurred in
    other states within 30 days of the conviction.
    • Notify their employer of any conviction within
    30 days of the conviction using the Report of
    Out-of-State Traffic Conviction by a Commercial
    Driver (DL 535) form.


    now, if it is IN a California CDL manual, then I am thinking that ALL states have this as well, as it is after all, Federal.

    SO, if true what I had thought, you have violated the law in NOT reporting your ticket to your home state.

    But, to be sure, I will continue to look, this time for Delaware's CDL manual.

    From the Delaware CDL manual http://www.e-gears.com/manuals/DE_CDL_Manual.pdf

    You must notify your employer within 30 days of
    conviction for any traffic violations (except
    parking). This is true no matter what type of
    vehicle you were driving.
    You must notify your motor vehicle licensing
    agency within 30 days if you are convicted in
    any other jurisdiction of any traffic violation
    (except parking). This is true no matter what
    type of vehicle you were driving.


    So it is highly possible that I might be correct, YOU still had to notify your state DMV, but what to do now? This very well may come up some day, if they call you on this, I'd hate to think that your license will either be revoked or suspended for violating the reporting?

    Wait wait! You guys, this person is getting an mvr. So it sounds like they don't even have their CDL yet.

    I was under the impression that law only applied to Cdl holders. If not that's a messed system and I'm sure quite a few people are illegal. But I'll be honest, I'm not all that sure.

    That being said, SLOW DOWN! The alternative to what you're asking is to contact the Delaware DMV and request an mvr from them. I know if you've held licenses in other states during that 5 years you do have to request an mvr from all states you had a license in.

    I had two big tickets that don't show on any MVR...but they show up in court records on a background check. Both were issued city police. Just answer any question honestly.

    The Delaware site specifies, NO MATTER the type of vehicle. Now however, it could mean ONLY holders of a CDL driving say his personal vehicle, or ANY LICENSE Holder of ANY driver's license, MUST REPORT to the DMV.

    I dunno, I'd hate for him to be crossing a scale, and they pull his license for a quick check, see the ticket in PA, but not reported in DE.

    Whatever, I did say a "disclaimer" that I "might be wrong".

    Oh and Vilhem, it's not uncommon for a driver to get a copy of his/her DMV report to make sure of any mistakes or misinformation.

    Thanks, Mr. Anthony for the insight.

    Vilheim is correct I do not have a CDL as of right now. That ticket is on a personal vehicle. The MVR came from DE, my home state.

    I'm mainly asking because every company I've contacted has told me thus far that I need to wait until it falls off my MVR, but if it isn't even on my MVR would there be wiggle room for me to be brought on? I've also only held a 4 wheeler license in DE.
