Wow way to disparage me with the quotations. I’m not sure you understood my reply since I was in no way soliciting advice on how to dispute the report. I disputed it already. It was for an accident that happened in a place I wasn’t physically in on the date of, for a company I don’t work for and never have, in a truck I don’t drive. It’s just a false report, for whatever reason my name and cdl number ended up on the report for an accident I was not even remotely involved in. And that’s the thing, I have no idea who to blame. But I do know that DataQs and by extension, the DOT are basically defaming me by sending prospective employers that report.
You can sue anyone, anytime, for anything. There are lawyers out there that will and do, take these cases. But, do you want to spend thousands to get pennies?
You must be new to this site or the internet in general. I was disparaging no one.. the fact is that until you can prove it to someone who actually matters using the process that you supposedly have ..this is a dead topic. The fact is that you've accused someone else of a "false report" when absolutely no one here can solve that problem for you. If you apply to companies and cannot describe convincingly enough that you were not at the place or had an accident in question then again no one can help you.
Have you considered identity theft? It might not be a false report at all, but someone else using your name. I would contact the local law enforcement where the accident occurred, explain the situation, and see what steps you could take just in case your identification was used.
You'd have to prove any damages you claimed. When I talked to an attorney about my situation, it was years after one prospective employer told me "it has to be accurate, it's on two reports we have". It turned out, the other report they had was a "plug-in" (basically carbon copy) report of the Hireright report they'd already had. Since the time to sue for that had already passed and Hireright subsequently corrected the report and I had no additional employer deny me employment due to their errors, I had no claim. If you want the corrected report sent to the employers who may not have hired you due to information contained in the report, then you should tell them to forward the corrected report to those that requested and received the incorrect report. I am not sure about the PSP report. Isn't that maintained by the FMCSA itself?
