    Don't tell me you read a document and the only thing that stuck out was Authority...TCA. TCA is not a who..its a what. It is the document identifier system that the epa uses.

    I guess we're on two different pages. I don't worry about "rule" I only worry about "Law". I didn't see who the "authority" was who published that rule. I assumed TCA was Texas C___ A___ or Tennessee C___ A___... EPA ranks right behind catching malaria on the "keeping me awake at night" scale. The last time I was stopped by anyone enforcing Federal EPA rules was........ Yeah, I never have been cited for violating federal EPA rule. Im a Tenth Amendment Patriot!

    I'm not worried either. This is the EPA document concerning tampering with OEM emissions equipment. As such it's a government mandate. Enforceable by any federal state or local jurisdiction. Most states don't enforce, but on the off chance you get a CVSA inspector, they are federal, and they will enforce the emissions laws. States that actually do sniffer test are most likely to check for opacity or visible smoke. New Jersey, New York, Wisconsin, Illinois, Nevada Oregon and what few others don't do equipment checks. It is an enforceable rule it does carry a monetary penalty that accrues daily. The majority of enforcement is directed at the companies that make the delete kits for pickups. I do know for a fact that trucks can be ordered with no emissions equipment at all, still. There are federal emissions requirements in effect, but trucks with pre2004 non egr meet the federal level. The 2007 and 2010 levels are CARB mandated. To simplify the assembly line process and an agreement with CARB all trucks manufactured with exhaust aftertreatment. You can special order a truck sans emission equipment for on highway use. The local KW has sold about 3 a month for about the last 6 months, Peterbilt sold 2 before Thanksgiving and we just sold 4 Macks. It's an export build list but it can be had in the US. If I remember right federal emissions laws for on-highway combustion engines go back to around 1974. As for the 10th amendment, it the federal government has established the rule. The powers of the state are their ability to add to the federal guidelines as in more stringent rules but they can't ignore the rule altogether. If you don't like government mandates as law example epa rules, then how about the FMCSA. They are not law makers but if you don't abide by their rules and you get caught it costs you money. Same premise.

    States absolutely do have the right to ignore Federal Law (or mandates). Ever heard of a "sanctuary city"? The state of Arizona routinely ignores federal rule, (gun laws, immigration mandates, education testing mandates, etc...) so its not beyond the realm of possibility that one of my state legislators could get something through the statehouse that requires law enforcement to ignore EPA mandates. It would be a long, expensive battle (that I can't afford to fight) but it could be done if we had a group for owner operators (like OOIDA was supposed to do before becoming irrelevant) to join forces and beat the EPA one state at a time. Thats why I am a firm believer in the 10th amendment.
