My "Super"visor will not take my pre trip inspections.

    This does work.

    Once I got pulled over for an unrelated issue and while the cop was doing his walk around I asked him if he would kindly mark the trailer tires as over due for replacement. He didn't put me OOS but I got new tires real quick like after that.

    Another example of drivers not knowing the rules as required and mandated..............................

    Read the post-trip inspection rule at 396.11. You must complete a report as to the condition of the vehicle at the end of your working day with that vehicle. If you drop & hook you must pre and post the dropped & hooked vehicles. How are you going to complete the report without falsifying the report unless you inspect the vehicle post-trip and how hard is it for a cop to figure out that you completed the report from behind the steering wheel and failed to inspect the truck when next day there are brakes out of adjustment and/or not working at all, turn signals not working with good bulbs in them, 3 lug nuts missing on one axle & 2 on another, and a broken frame on the same trailer you used the other day?

    Then you must ensure all defects are fixed before using the vehicle again pursuant to 396.11(c)

    The pre-trip rule, 392.7 is only that. Nothing in the 392.7 pre-trip rule required you to complete any report as to the condition of the vehicle. That is done post-trip per 396.11

    Here's the post-trip rule:

    PART 396_INSPECTION, REPAIR, AND MAINTENANCE

    Sec. 396.11

    Driver vehicle inspection report(s). (a) Report required. Every motor carrier shall require its drivers to report, and every driver shall prepare a report in writing at the completion of each day's work on each vehicle operated and the report shall cover at least the following parts and accessories: --Service brakes including trailer brake connections --Parking (hand) brake --Steering mechanism --Lighting devices and reflectors --Tires --Horn --Windshield wipers --Rear vision mirrors --Coupling devices --Wheels and rims --Emergency equipment [[Page 473]] (b) Report content. The report shall identify the vehicle and list any defect or deficiency discovered by or reported to the driver which would affect the safety of operation of the vehicle or result in its mechanical breakdown. If no defect or deficiency is discovered by or reported to the driver, the report shall so indicate. In all instances, the driver shall sign the report. On two-driver operations, only one driver needs to sign the driver vehicle inspection report, provided both drivers agree as to the defects or deficiencies identified. If a driver operates more than one vehicle during the day, a report shall be prepared for each vehicle operated. (c) Corrective action. Prior to requiring or permitting a driver to operate a vehicle, every motor carrier or its agent shall repair any defect or deficiency listed on the driver vehicle inspection report which would be likely to affect the safety of operation of the vehicle. (1) Every motor carrier or its agent shall certify on the original driver vehicle inspection report which lists any defect or deficiency that the defect or deficiency has been repaired or that repair is unnecessary before the vehicle is operated again. (2) Every motor carrier shall maintain the original driver vehicle inspection report, the certification of repairs, and the certification of the driver's review for three months from the date the written report was prepared. (d) Exceptions. The rules in this section shall not apply to a private motor carrier of passengers (nonbusiness), a driveaway-towaway operation, or any motor carrier operating only one commercial motor vehicle.

    Maybe this is why Krispb's supervisor won't take your "pre-trip inspection reports" because you're not supposed to do a report pre-trip and he/she is waiting for your post-trip reports which haven't been completed.

    You'd better read the pre-trip rule at 392.7 and the post trip rule at 396.11 because this guy's supervisor is correct.

    It sounds to me like his supervisor wouldnt care what kind of inspection report it was, at least thats the way I take it. I would do your report right, at the end of your shift or trip or whatever you do, or hand him the one you did yesterday and let him know they "HAVE TO" get it fixed. If he shows no interest or dont care then do what southernpride says, stop and ask for an inspection. Granted you can say your not gonna drive it till its fixed and they can tell you goodbye and you can go to court etc but in the meantime you still gotta eat and pay the bills and I think finding a job nowdays might be a little harder than it was even just last year so............get your truck fixed one way or the other.     You forgot to mention the 18% interest on the back pay that the U.S. Dept. of Labor gets the driver.

    Thanks for the help everyone!!, Instead of dealing with my boss I went to my driving school instructer today (on the clock) with the truck and he went through the truck. The drag link is warn but not to bad, but it should be replaced anyways he said. He also said I need to get a Federal inspection in the truck since I drive through 2 states that require it.MA, and CT( it goes bad June). I'm going to their repair shop on monday to schedual an appointment on Monday for the repair without telling my boss that I going there and MAKE SURE the Mechanic calls him and tells him the importance of the replacement. I truely thinks he has and unmedicated Bipolar!! Oh, and where can I get a new pretrip book, I only have one page left and what do I do with the old one? Also I just learned that I have to document all the miles that I drive in other states for the fuel tax sticker.?

    Wait until you're fired for not getting authorization for repairs.

    It can be remarkable for many reasons.

    I have worked at companies that required a pretrip to be completed. Note that I said pretrip. The DOT requires a Post trip. Guess what. The company paid the salary. I did the pretrip and also a post trip.

    You have to follow company policy as well.

    Psanderson, I just got my licence 2 months ago, they did not tell us that in school. I have no other drivers to talk to and learn from. There is no need for the sarcasim, please. I don't know these things and this is why this is a forum for question FROM NEW DRIVERS. I do a complete pre and post trip inspection everyday but I just keep both copies in the truck with me because like I said earlier the boss dosn't want them.
