There is a law, in fact a body of law with regard to the duty one party owes to another. Failure is called negligence and results in liability.
Can't imagine a court that would sanction abandonment under any circumstances except a trainer who felt in imminent danger from the trainee. That's not, apparently, the case here.
Even if that were the case, there would be a duty to inform law enforcement, authorities. Fortunately, JustPj was driving... Once Navajo knew that JustPj was exiting or being exited from the truck, it had a duty to get her to a safe place.
And transportation home.
If our standards do not rise to that level, we need to change that. A trainee would be crazy to get into a trainer's truck knowing that the trainer had a 'right' to dump them off and strand them like this.
There is no abandonment 'right'.
Navajo Express has just abandoned this trainee in a tiny town 1500 miles from home!

Justpj,
I would consult a transportation lawyer about suing them in civil court. Make sure you keep all the receipts on what it costs to get you home including your motel ones. However, first order a copy of your DAC and see what it says. If they dinged it pretty bad, contest it. I would ask the lawyer to review this thread and ask her/him what you could sue for. I also would contact someone about wrong termination.
You asked what you could do to repay us for being so friendly to you in a previous post: Do the right thing and go after them. Don't be greedy but go after them as this situation could have been avoided. Even if you decide not to pursue this, we'll always be here. Its one big family on this forum.Leftlane101 and Lux Prometheus Thank this. -

HIPAA is by far the strongest and most stringent when it comes to personal information held by private companies and therefore is often used as the standard by other industry because it covers all the bases.
I got educated by my wife when she started talking about HIPAA. I asked her why she or her company was worried about that because they have absolutely nothing to do with healthcare. She was sent to months of HIPAA schooling and that's the way she said it was explained to her.JustPj and The Challenger Thank this. -
