Need a little advice

    I need some advice from you all, today i went over and picked up a load of seed corn and beans on a dropdeck trailer, open sides, had beans in plastic pro boxes weighing 2500 lbs each, 2 per row, strapped down, corn in bags was all strapped down except for one small skid in the last row centered in the middle of the trailer, shrink wrapped well but not strapped down, only 25 bags so thought i'm only going max of 5 miles to home, never moved an inch and then an over zealous police officer motioned for me to pull over, i was stopped at a stop sign, thought no problems, all my paper work was in tact, recent safety on trailer and truck and not over weight at all, but he was having a bird about this one skid at the back, he fined me $390.00 for an "insecure load", i explained everything and long story short he said he could drop the fine but smiled and walked back to his car, he gave me some advice saying i could either pay the fine, plead guilty with an explanation or go to court, he marked my CVOR license down on the ticket and i can imagine it will effect my record plus maybe increase my insurance, basically he told me to plead guilty with an explanation and maybe it would get thrown out by the crown prosecutor but a friend also a police officer said just fight it and take it to court, right now i don't have time as its getting close to planting time. So whats your advice, plead guilty with an explanation is what i am leaning to and hope it gets tossed, just don't want it to mar my clean record, hope some guys from Canada or Ontario can give me some advice and thanks for any and all replies and sorry for the long rant, just ticks me off that this officer is so gung ho for something so minor, am i wrong.

    Other than, next time strap it down, go to court if you can and see if they will just give you the fine and drop the charge. Like a donation of sorts?

    Not familiar with Canadian courts but i fight anything like that. I have always had good luck. Hopefully with your clean record and a good line of b.s. maybe you could get it reduced or even dismissed? Let us know how it turns out, whatever you do. Good luck to you........ david

    Not meaning to stick up for the cop but..you did have a pallet that was visible to anyone that was not secured, technically and legally you did have an unsecured load. That's not to say that I wouldn't have done the same thing, but when doing stuff like that you do take a chance on getting caught.

    There is always what you can get away with and what's actually legal...sometimes you get bit. Maybe tell your story and even lessen the distance driven and see if the prosecutor will drop it to a less serious violation.

    When it comes right down to it... you did it.

    Appear on court and have it remanded to such a time that you can attend to fight it.
