ok lets start this from the beginning. I left my truck at a small shop to replace the clutch and they told me it would take 3 days. I own a 2000 freightliner century with a meritor ess style transmission. I called on the third day to check the status on my truck. They informed me that they did not have the tools necessary to replace the clutch on my truck so they had to move it to another shop. How they moved the truck i have no idea because i had to have it towed there. Then they tell me it'll be another 3 days to get done. i call again after another 3 days pass and its not ready again. this time they inform me that they had to send the flywheel to a machine shop and its been at the machine shop for 2 days. then inform me that it will take em about 2 days to tighten everything back up. call in 2 days and sorry not ready yet will be done in the morning. call in the morning and not ready, call us at lunch. not ready at lunch will be ready in 3 hours. Show up at the shop after the 3 hours and i wait half hour for truck to show up from where they had it. the manager infroms me that 5 bolts where missing and replaced. fluid level in transmissiobn was low so they changed the oil. first time i ever heard about those issues. fast foward to now, not even 2 months later. my clutch goes out in the middle of a run and i have to get towed to freightliner. i find out a drive shaft bolt was missing, clutch i shot and some of the adjustment teeth are broken where it was either installed wrong or oer tightened. i call the last shop that fixed my transmission and inform him of the situation he tells me freightliner is crazy and says he will go to look at truck in 30 minutes. well i decide to go meet him at freightliner and he is not there so i call him to see where he is. he tells me "im at freightliner", i then inform him im there and "oh your there? ill be there shortly". he shows up wants to go look at truck we are taken to the back by the mechanic now dealing with the truck. the mechanic explains the situation to the man and the man seems reluctant to accept this as true but he doesnt say anything. the man then offers to take the truck back to his shop and he would repair it for free but in my mind im thinking "you dont have then tools at your shop, last time it took you over a week, time is money and dont think you would fix it correctly". So i tell him no ill have it taken care of here at freightliner. We do come to an agreement that i will send clutch out to be checked by manufacture to see if by chance it would be defective. if it came back defective ok i will just get the money back from where i bought the clutch, if not then he would repay me for the clutch installation but keep the money for the labor on replacing bolts and transmission fluid. Well the next day freightliner calls me and tells me to come in they have some things to show me. When i show up they show me pictures of how my transmission was missing like 6 of the top bolts and inform me that they had to remove 2 other bolts that had broken. they also inform me that i will need a new drive shaft because it was either installed wrong or since it was misssing so many bolts that caused it to mess us. so now the bill is looking like OVER 4K!!!!!!!!!!!!!!!! so i call the gentleman who last did the transmission work and asked "what 5 bolts did you replace on my transmisssion?" he kept insisting that he didnt understand my question and asked what freightliner said was wrong . he then said he couldnt tell me which bolts where missing without seeing the transmission. i infrom him of the situation at freightliner and he says they couldve just taken the bolts off then take those pictures. i tell him that i want him to now pay the entire bill at freightliner because it is no longer a question of product quality it is now clear they dont know how or did it wrong. he says since i refused to allow him to do the work again it is no longer his problem. i inform him i plan on taking legal action and we argue back and forth about it and i tell him that we will see what a lawyer has to say and he hangs up. my question is if i have any grounds or legal ability to make him pay if i file a civil suit because in my opinion the first shop didnt get it done and the way i was treated gave me no reason to trust them and the missing bolts made it clear they didnt know what was going on. any help would be great. i know people arent perfect and make mistakes but why take your truck back to a shop who didnt do it right the first time and i pretty much had to babysit or look over to get stuff done. i own my truck so time is money and being down because of someone else's mistakes isnt very pleasing. please help

You may well have grounds to file a suit. Keep in mind, that the majority of suits (98%) settle out of court and it usually takes the better part of a year to get to that point. Personal experience.

I would check my engine serial number. They probably stole your engine and your transmission. Thats why they took your truck to where you couldn't see it and why it took so long. You will probably have to murder this guy and burn down his shop.

Get all the documentation and take notes of EVERYTHING every tech and service manager tells you. Get there name, date so when you need to call on them for statements for your hearing you wont need to try to find the guy that was working here when your truck needed service 3 months ago. Stick it up his ###. I can not stand these useless shops overcharging for sub-standard service. And you should feel great for going through the trouble of suing this piece of crap, just think how many other guys have gotten screwed by him before. Good luck my friend.

This is why you don't buy a 13 year old piece of junk. Freightliner makes a good truck but they are throw away trucks after 10 years. It's like investing in a worn out Dodge Neon.
It sounds like you took the truck to a fly by night place that is only capable of light repairs. They didn't have a transmission jack. So they pawned it off on their buddy who had the jack but not the knowledge. Anyone can turn a wrench. A good mechanic will blueprint a repair to factory specs.
If you take it to court the judge will want solid proof in writing or witnesses like from Freightliner. He said, she said doesn't get it in a courtroom. If you have a detailed invoices from both places might suffice. So be prepared for your case. If you go prepared the judge will rule in your favor.
But work on getting you another truck with less than 500,000 on it or you will have many more expensive repairs and down time.
It's okay to dream big but don't put the cart in front of the horse. You don't even have one year experience. It doesn't matter what business a person goes in to, you have to be experienced with that business to be successful.Tennesseahawk and aiwiron Thank this. -

I am getting all the pictures freightliner took and the ones I took I will also get the names of the guy who is working on it at freightliner. In case the gentleman doesn't want to settle this I want as much in my favor as possible just wanted some opinions on wether I would have a legit case if I would have to take him to court.
