Need advice ASAP, Company won't get me back to the yard.

    You know what’s funny I actually decided to go with SPD 4 months ago when I read his thread. Overall they were fine, but once I told them I quit it went south. I just learned my lesson to only quit these mega corps when you’re back at the terminal…or better yet, not work for one to begin with.

    I agree with you. I was just comparing what I quoted. And those engineers would still be able to get a decent paying job. We as truck drivers more than likely wouldn’t.

    Can't be the end of the world. Schneider & Hurricane hire drivers to go all over Gods green earth to recover abandoned trucks. Surely those drivers who left the truck behind a Walmart found employment somewhere.

    One of our guys abandoned a truck on the other side of town.. about 8 miles from the yard. I seen him washing the parking lot of a Circle K about 3 or 4 months ago.

    Yeah, the problem is that we have a CDL process that is too easy, it is where in most cases a 14 year old who reads the CDL manual can pass the written exam - that's wrong.

    Most drivers who are coming out of the CDL mill don't even have enough education on how the truck works and can't understand some of the basic common sense things on a truck, there are threads made here that ask questions that should have been part of the training.

    Until we get serious about this being a profession and not just a job, it is what it is; we are the scourge in the public's eye and targets for litigation for even minor things.

    When I had to chain up in Portland a few weeks ago, the freeway was at a stop, I had FOUR drivers see me putting my chains on and come up to me to ask if I’d do theirs as well. They had ZERO clue how to do it. Have had numerous drivers ask me to back in their trucks into tight docks the past few months and one wasn’t even really tight. I’m convinced the reason they park in the fuel isle holding up the line is that they truly are that clueless and don’t even know or realize what they’re doing.

    It would never fly because the truck is issued to you. One requirement that you stole a truck is that you were not authorized to drive it. It was ISSUED TO YOU. So you might not be taking it where they want, but it's not theft. Especially if you can show, which is not difficult, that you're taking the truck back to their terminal. That's not theft. GPS, especially tracking software like Google, can clearly show you taking it directly back to their yard. That's not what a truck thief does. That's what a driver who is done with a company does.

    If you have the keys and can show on your ELD the truck is issued to you, your company can be criminally charged for filing a false police report. In fact, when you quit, you have a DUTY to return their equipment to them. Showing that you are doing just that would quickly clear you of any criminal charges and then you could sue your past employer for false arrest if you get arrested or for filing a false police report against you, depending on what they do.

    You cannot be held hostage to their truck. So them saying "We'll kill your DAC if you abandon the equipment" and then from the other side of their ### say "If you deadhead to the terminal we'll call the equipment stolen" is holding you hostage. They can't do that. You can absolutely give then a reasonable ultimatum, making them decide on what they want you to do, and if they don't do it, decide on your own what to do and go for it. That's what I did with my last company. I told them to have me at their yard no later than Wednesday as I was turning in the truck. They failed to do it, so I told them their truck could be found at a local truck stop with the keys on the seat. I told them they were not holding me hostage to that truck. I had obligations to my new employer so I was moving on. I didn't care. I had no issues finding another job as I already had one when that happened.
