Need advice on a ticket I recieved

    September of last year I got pulled in for a random lvl 2 inspection and the only problem I had and received a ticket for was not having a texas certified vehicle inspection. The next morning I call the safety department and fax the paperwork and was told not to worry that the company would fight the ticket. Reason they would fight it is the company mechanics do the vehicle inspection s and even though the tractors license plate is from texas if your domicile terminal is not in the state of texas it is not required to have a texas certified vehicle inspection.

    Soo 3-4 months go by and I get mail from texas saying the ticket hasnt been paid and I call the safety department and was told it must have fell through the cracks they will take care of it. Soo 3-4 more months go by again and another letter of it not being paid. I call the safety department again last week and they will take care of it. I call today and they tell me to call my dm (that made me laugh) I get my point across and was told they will email my situation to the safety director.

    I know I waited way to long as I blindly thought my compay would actually handle the situation and lesson learned , but I go ahead and call the number on the mail I recieved about the ticket. The nice woman informs me that my company has never contacted them and the ticket needs to be paid or I could fight it but I and someone from my company would I have to show up in person and that my license is probably already suspended. I call the state of Florida and my license is not suspended. (Yet)

    Soo my question is what would you do or even better what should I do. Pay the ticket as im thinking my company isnt gonna do anything for me and I dont want my license suspended or keep calling my safety department everyday until they handle it or maybe offer to pay it as I did nothing wrong and it was just a misunderstanding the state trooper had with the rules and regs on texas state vehicle inspections

    Call your safety department tomarrow and clearly state that you have given them plenty of time to fix thier mistake and if they do not take care of it immediatly you are filing a small claims case against them seeking compensation for the unpaid ticket, down time away from work along with any and all lawyer fees and court cost. After the ticket is paid then quit and go find a real company that doesn't use their drivers. Good luck.

    I would pay it ASAP, then fight it out with my company.Your license is too valuable to gamble on your company doing the right thing.BUT I would keep after my Safety Department, DM, and anybody else I came in contact with to re-pay me.

    The actual ticket doesnt even have a price just a court date. Today when I called its 195 $.

    Become a member of OOIDA, contact the compliance dept. of OOIDA, fax all paperwork to them have them call your company. They'll know what to do. good luck

    If I were you I'd pay the ticket immediately and then demand reimbursement from your company.

    Was it inspected in FL? They aren't on the list as a qualified state.

    You are kind of between a rock and a hard place. Many companies will tell you they will pay the ticket and leave you wondering. I always tell them I'll pay it and give you a receipt if it's just a few hundred. What could of happen did happen.

    The bottom line is your CDL is your bread and butter and you always protect it. I would pay the fine immediately online if possible. If not send the payment quick like. Reimbursement is another story. With a receipt in hand they should pay it, but only give them a copy and not the original receipt should you have to take it to small claims court.

    So what you are saying the truck was inspected and not expired? It's a whole different ballgame if it was expired. Evidently they know some of Texas law but not the limited state part. Since they don't have a reciprocating agreement with FL inspections they might not have with the suspension thing too.

    I would talk to safety face to face. This could be the result of a bimbo in the office so I really wouldn't quit unless you are also unhappy with dispatch and your paycheck. Make sure you have a full 1 year experience before you do and quit the right way without burning bridges.

    STOP!! You may have a suspended license in TEXAS. There is a thing called the Non Resident Violator Compact. Texas can suspend your Texas driving privileges even if you don't have a TX drivers license. Once they do that it takes awhile before they notify FL. Texas should have sent a letter to the address on your drivers license telling you of the pending suspension. Get in touch with Texas to see if they have suspended it. I want to say there are only two State who aren't part of the compact, you might get lucky....I'm not that lucky.

    I think the safety department are a bunch of jerk!

    You said the vehicle in question is registered in Texas, if Texas says that CMV registered in their state have to be inspected by their state then it doesn't matter where that vehicle is parked, domiciled, or driven by. It has to be inspected by a state agent.

    My company doesn't have any vehicles registered in Texas, they are registered in RI & ME. But RI has the same dumb law as Texas that all CMV registered in the state have to be inspected annually by a state agent. It doesn't matter if it a day cab I have it domiciled in CA driven by someone from FL.

    Pay the ticket and cover your a--. Bring a copy of the ticket, letters, and receipt to safety and tell them to pay if not they won't chalk it up to experience and switch carriers.

    If you sue them they can put on your DAC that they are currently in court proceedings with you and that other carriers are not to contact them. Now they didn't say anything bad about you but how does that look to other carriers looking to hire you.

    Besides you would have to file in the civil court where the carrier is head quartered and then show up for the court date at which point they either will not show up then you do all work attaching a lean or they will ask for a continuance at the last moment and then you will have to come back and they can do it a again. All over $195.00. You will lose twice that in pay showing up for court.
