Need advise for a question

    I work as a spotter/shuttle driver ok last year I was backing a trailer up in a gated lot I work night shift and it was raining hard as I was backing my door did a 90degree and I pushed the dock door off the track and did damage to one door on the trailer.OK I ran my dac report and it said I have a dot recordable on my record everything i've read about dot recordables says it has to happen on a highway or interstate.Doesn't this also have to be on your mvr record if it's dot recordable.Should I dispute this not sure how to get this off if the company wont take it off do i call the dot.Need some advise please.

    Where did you read that a reportable "preventable accident" is only to be reported on DAC if it is on a public road?

    I agree, it has to happen on a public road to be recorded so I would question it

    You can dispute what is on your DAC record. There should be information regarding how to do this somewhere in your report or on the website. Only moving violations are on your MVR; speeding, accidents, running red light ect.

    Here is the FMCSA rule:
    The Department of Transportation has certain requirements that must be followed when it comes to accidents and the records that must be kept for accidents. According to part 390.15(b) of the FMCSR, motor carriers must maintain for a period of three years after an accident occurs, an accident register and copies of all accident reports required by State or other governmental entities. The DOT defines an accident as an occurrence involving a commercial motor vehicle which results in: a) A fatality b) Bodily injury to a person who, as a result of the injury, immediately receives medical treatment away from the scene of the accident, OR c) One or more of the vehicles incurs disabling damage, requiring it to be towed from the scene

    See item "c)"....disabling damage, requiring it to be towed from the scene....
    This is where they could have you. If the damage you did to the trailer door made it unusable for freight before repairs, then it had to be towed to get repairs.

    No, incorrect, any inncident/accident can be considered "recordable", your employer had it added, but doesn't mean it will be on your MVR

    This actually doesn't have anything to do with the op situation, an employer can choose not to ad a inncident that happened on their property to your DAC report, no law enforcement evolvement, no citation from any law enforcement, sadly is employer decided to have it on his DAC, he can fight the inccident on his DAC, and they will contact his employer, if the employer chooses not to dispute, them DAC will have it removed

    You are assuming the trailer was equipment owned by the OP's company. If the trailer damaged by the OP was not property of the employer, but was "foreign equipment", then the OP's company would be responsible for repairs done by their driver....but you are correct, in this instance, the OP's company has a choice to report or not report on DAC...which is completely separate from and noninclusive of the DMV and his DMV driving record.

    It don't matter who what when or where. IF a driver makes contact with a fixed structure or another vehicle and damage results said drivers employer is TOTALLY WITHIN THEIR RIGHTS TO REPORT SAID CONTACT TO DAC. The concept of a DOT reportable accident is a red herring in this situation. While you might have the right to contest any information in your DAC this don't give you the right to have legit negative information removed, and it won't be.
