I am a private investigator working on a civil action against Yellow Freight; resulting from a fatal accident that occurred on I 90 in Cleveland, OH on 12/16/2008. The Yellow driver was hauling double empties from NY to IL under hazardous winter conditions. He did not want to take the load, under those conditions, but was ordered to by the dispatcher. Looking for any ex-Yellow drivers, dispatchers or management willing to state that it was Yellow's policy to deliver no matter what the road conditions were at the time, especially doubles or triple trailers, and empty. Thanks in advance

You mean looking for deeper pockets. I guarantee you the written policy is for a driver to never endanger the public, equipment or the driver himself.
You know the company attorneys have made sure that it is never the companies policy to force a driver into a dangerous situation just for profit.

Why would they haul empty trailers that far?

probably some dick tm that ordered him, i doubt its company policy to drive no matter what. probably should have called up his local union and/or steward and asked what he should do.

If there is freight at your terminal that needs to be at another to meet a break time, it will be shipped, even if nothing is coming back. In that case empties will be returned to the home terminal to replace the two shipped out, and to get the driver home. This works the same if there is freight coming to your terminal, but no freight out. Empties are taken and exchanged for the loaded ones.
If a driver is assigned a line haul, and there is freight at even one end of the run, the driver will be sent. I have hauled loaded sets out, and came back with empties many times.
LTL freight companies reputations are made by providing on time deliveries. If a big customer has hot freight sitting on a truck dock when it was promised that day, someone else will haul it next time.Big Don Thanks this. -
I do believe that at least some states have laws about operating triples in "severe" weather. Now I could be wrong about this, maybe it was just policy at the company I worked for, but I really do think it was a Utah state law.

Most compaines state you go.
But if roads are closed by the police or state then you can park.
LTL companies are the worst about this.
More outfits are now telling drivers if you do not feel good about the roads park.
Some even state if chain law on, you park at the first safe spot.
But then you get the rest that say go no matter what.. -
It is amazing to me how a company "made me" run in bad conditions. I am a grown man and there is NO company that can make me do anything. It sounds like this driver messed up now wants to get a check for it. Bottem feeding lawyers are just as bad as bottem feeding trucking companies.
