Hello, I am trying to understand the process a trucker go through to gate in a full container at Los Angeles port. A Go Dependable trucker gated in my full container but the terminal noted it as an empty by error. Then the terminal released the full container as empty to another driver and my cargo got lost. Dependable told us that it is not their driver fault and the port advised that driver should notice and notify the clerk error instead of leaving. Please I need any information you can provide me to make Dependable responsible fort my cargo loss. We hire Dependable a as a trucking co and Maersk as a steamship line, both companies were in custody of my container and none of them wants to accept their responsibility. Thanks.

Wow, what a mess. Sorry to hear all that. Unless someone steps up and does the right thing, it may be cheaper for you to go buy that product back off the street. It may all be in a flea market by this afternoon.

Contact a lawyer today. Somebody basically stole a whole container load of your product. I am assuming the steamship line has to show some sort of proof they delivered your product to your end customer as well as the truck line.

If Dependable dropped the trailer and Maersk received it then it's Maersk's fault. The trailer is sealed, correct? It's the guards responsibility to verify the trailer is sealed or empty to maintain the integrity of the load. How he wrote it down is on him. He should of done his job instead of watch the Price is Right in the guard shack. They took possession of it.
Then the full trailer released to someone else? They need to fire that guard.
It's typical for someone to try to avoid liability and pawn it off on someone else.
They should know who that other driver is that took off with your load. Those people should be contacted. Where's my load at? If you don't get satisfaction there then get an attorney if you have to and go after Maersk. They don't have a leg to stand on.
It sounds like a criminal element is involved here. I would also contact the law or port authority.walstib Thanks this. -
Maersk did not accept their error. They referred that truckers driver received an EIR at the gate in and the EIR is their receipt of the transaction. The transaction clearly states Receive Empty In and if there was a problem then the trucker should have brought that to the attention of the terminal. They insisted that the gate clerk at the terminal indicates what type of transaction is taking place (receive empty, full, etc.)
and if received empty is announced, then there is no validation of the container weight, even though the truck is resting on a scale. With all this being said we tried to make responsible the trucking co Dependable but they gave full responsibility to Maersk who received the container. This happened 6 months already and we could not find a way to resolve it, on top of that now the trucking co is threating us that we ill be sent t collections if some invoices are not paid. The trucking company that picked up the container from you is responsible to you. I would think that would have used a freight forwarding company to handle the process for you. You need to call Law enforcement to start a claim on the product. Once the product is signed off on by the driver it is owned by the trucking company. Make sure you have a signed bill of lading. Then contact the bonding agent for the truck company.

This should really be simple contract law. Who was responsible for the load when it was lost or misplaced? Lawyer up.
