Need Help - Stuck with very bad company

    Bottom line is, YOU are the one responsible if anything happens...even if he told you to do it. If he told you to kill someone would you do it? Well in a way, he is. Think about that, then take his truck back and politely give him his keys.

    You just have to realize that employers/dispatchers/etc will use and abuse drivers. They know it's not their rear end if you get caught coloring your logbook or get busted for being severely overweight at the coop. It's your career you're playing with and putting in jeopardy. "Boss/dispatcher told me to" never flys with DOT or state patrol.

    The guy's a dirtbag who runs a shady small time outfit who preys on desperate guys like you who want to drive a shiny truck and trailer. You're better off working at a larger company where the trucks may be crappy but at least they can't strong arm you into driving illegally. Having a big carrier on your resume may look better or more legit as well to future "better job" employers.

    You're probably better off to get out now. Chances are YOUR CSA score will eventually take a hit working for someone like this.
    Also I second what 123456 said. I managed a company (auto) for many years. Not only is a secret recording inadmissible, it is illegal for you to do it by phone.

    Wow... 250 miles per hour... hum paid by mile .... ya only wish ya had a truck like that and a company to pay for the fuel on the new USA autoban, maybe in year 2150. You could make a mint. Well I can dream the imposable dream.

    I agree with what some said,. yes a recording is in admissible in a criminal court. How ever it is very legal in a civil court room and it is legal to record your own personal conversations.

    It is not my intention to use the recordings in either way. Only to use as leverage to prevent him from giving me a bad reference or worse to prevent him from entering false info into my DAC report.

    I'm going to try to hang in here to get at least 6 months under my belt. I was really hoping to get a year in before quitting but it will be all I can manage to hang in here for 2 1/2 more months, if I can hang in here that long.

    I enjoy trucking. But not like this. If I saw home time 4 - 6 weeks it wouldnt be so bad. But like I said,. I havent seen home since January. My dog is likely to have forgotten me by now. The yelling and threatening to fire me, leaving me stranded in the middle of no where and threatening to report me as abandoning the truck if I dont run over weight loads or 'pencil in' restarts has got to end. I miss my family terribly and can not wait to start with better company than this.

    Thanks for your comments. This is a very real and honest situation I am in. I dont understand why someone would think that I would make this up. For what purpose? What gain? I have pictures, documents, and now,.. a couple recordings already. After I leave here I will reveal all so anyone who reads it will think twice before hiring on with this guy. The things we are required to do and put up with is mind boggling.

    Its easy to tell me to go ahead and quit when your the one making good cpm and have the required time under your seat. Try finding work with less than 4 months of recent experience. I refuse to pay a refresher course. Its the same type of extortion in my opinion. I will get the experience I need and hopefully retain my sanity afterward.

    Thanks and I will make it through this. I am in a better state of mind today then the last time I posted.

    Listen dude erase your recordings or whatever you have for your leverage because the way you present yourself here and the picture you present of him....when you pull out your evidence he's gonna beat you up....I promise you...bad...put you in the hospital....or scare you so bad you wet your pants...please just take it cause there is no hope for you or your situation....

    If you find a new job before you leave he wont have time to ding your DAC report. And if he does later you are already working and can challenge it and hopefully get it removed. But really...just leave before you have a nervous breakdown. And always remember nothing shuts up... and slows down a loud mouthed bully like a throat punch...

    A DAC report is not the end all of trucking. It is also disputable, and the company needs proof to back up what they are saying.

    Well that is your prerogative. There are tons of companies that will take you with the experience that you have, but you sound like you are not interested in doing what is necessary to change your situation.

    Your dog hasn't forgotten you. Did somebody steal your truck too? Because this is starting to sound like a country song. The bottom line is that YOU are breaking the law, and you will get no sympathy from me. You are the captain of your ship and of your life. How's the wifey and puppy dog gonna feel when daddy is in jail for manslaughter because he ran over that family of 6 in his 12th hour of driving? Where do you think the owner of the company is going to be?? I bet he won't be backing you up

    To be honest, the thought crossed my mind as well. It's hard to fathom that someone with a family would put up with what you are putting up with...and instead of actually taking steps to improve your situation, you are on an internet forum ######## about it. It's time to man up.

    So now you are attacking the posters that came on here to try and help you better your situation. Common sense is not so common and it's sad. Again, there are dozens of companies that will take you. Stevens, Swift, Werner, Prime, England, Knight, Schneider, Central Refrigerated, etc.

    You need to grow a pair and do what's right. Only you can change your situation. I do wish you the best of luck, though, in whatever you decide to do.

    I have already made a few phone calls and done some online apps. I talked with one recruiter from CTL who wants me to fill out some more paper work she is sending me. It wont be OTR, but local work and paid per completed load. Doesnt seem too bad. I'd really like to get in with a company that does OTR because that seems to be where I can make the most money once I get some time under my seat.

    You have to understand my predicament. Not attacking anyone here personally. Please dont take it that way. I felt a little insulted that someone would accuse me of making this up.

    I honestly dont know enough about trucking and how the industry works as a whole to feel as comfortable about quitting as you guys say to do. When I was driving back in the 80's and 90's finding work was very easy. Now you have to carry a paper trail of your work history and I dont want any dings on my report. My plan is to have another job waiting before I give my notice. But I want to do it the right way and not just leave the truck sitting for him to pick up and report me as abandoning it. He will fight me on this and tell me to just leave it. I need for him to understand that I wont/cant do that and need to leave this company on peaceful terms with him no matter how much I hate the prick.

    I understand where you are coming from. I am doing my best to minimize driving while fatigued. I have been pulling into rest stops and getting power naps before heading back out on the road. I did this the last couple nights and took an as* chewing for it this morning already. Believe me, no one wants to tell this guy where to stick it and leave more than me right now.

    Gotta run, just got my bills and need to head out.
