I am trying to learn how the trucking business works. From what I can tell Swift has the worst reputation bar none.
I was hit by a new Swift Transportation driver from behind, sent me to the hospital and totaled my car. From what I can tell they are really treating the drivers poorly and sending out inexperienced drivers with poorly maintained trucks. The driver that hit me was empty and should not have been near as close as he was. I really don't want to get anything from the driver just make Swift pay for caring more about money than people. Swift has not made a good faith effort to even make a decent offer.
We will be in depositions shortly, requesting documents, etc. I want to make sure my attorney asks for everything he should. I think we need the log book, black box download, any GPS readings the company has. Anything else?
Do the maintenance records have a special name? I heard that sometimes the company will fake the log so check the log against other documents, what should I ask for to verify the log?
Do I need to get the driver's mentor name? Are there any practices at Swift that are shady that I can subpoena?
I see there is USIS, DAC, Can I get these records.

You probably need to demand the Qualcom records. Others on here can tell you the best course of action as a good lawyer should do. I'm sure your attorney can search other cases against them and have a wheel barrow full to go into court with. Good luck.

Log records with supporting documentation: fuel receipts, toll receipts, and "PrePass" records (if Swift uses PrePass)
Employee records: with Swift and previous employers. USIS records. INCLUDING results of every drug/alcohol test
Maintenance records for the truck and trailer.
You won't get anything from the driver anyway, chances are, he is as broke as I am. (LOL)
Swift is "Self Insured" and they won't make any effort to settle until it gets close to trial, then they will "LOW-BALL" THE HELL OUT OF YOU.Last edited by a moderator: Aug 21, 2008

If you have to tell him/her what to do, maybe you should get another lawyer, or just let him/her do his/her job.

i have to agree with razorbacker you need to find a law firm that is experianced with the industry and STAY AWAY from the tv commercial lawyers they are scum you will run the possibility of making the jury unsympathetic to your case, or worse yet the opinion of im tired of hearing the B.S. that these guys spread and now there wasting my time not guilty wake me up when where done. im not saying that that is the case just the opposite here good luck keep us informed and we will offer any additional insight into the issue as we see it form our side of the fence

Sounds like another person wanting to take advantage of the big trucking companies insurance and deep pockets. Accidents happen and all drivers make mistakes, should they pay for your car well sure and if they dont thats what you have insurance for, right? Should they pay for medical bills absolutly no question. As far as poorly maintained equipment, i see alot of nice and pretty new swift trucks on the road, and if the unit is in that bad of shape then the driver should not drive it. These are my oppinons, take them for what it's worth. FYI if you had insurance your insurance company should pay your bills and go after swift to get them paid back.
