Need some advice

    Hope you got your popcorn. Here it goes:

    So I've been working for CR England. Been with the trainer and finishing up my hours. My trainer lately hasn't been doing to well he has a tooth abscess and for the last week only been doing 250 miles daily before he can go no more and I've been doing the blunt of 550-610 miles (mind you there trucks only go 62) everyday since the last week I had to do a 34 and 6 days later finding myself with only a couple more hours before I have to do another one.

    Anywho he had one more load. I asked to upgrade in south holland Indiana(500 miles from where I was at) Driver manager said no and wants me to upgrade in Salt Lake City (1200 miles)and after 25 minutes arguing I said screw it I'll go to salt lake. He gives us a hot load. 100 empty 1120 miles loaded due in 24 hours holy ####. Mind you my trainer ain't doing so hot and requested since last week for a place to stop and get his tooth checked and was ignored. So I pick it up and do 550 miles that day could of done more but I was stuck about 40 minutes at the pick up. Trainer swaps and only does about 110 miles he can't go no more his head hurts his eyes hurt he's coughing sneezing and fever. So we go and stop I didn't sleep much with all his coughing and neither does he. Slept maybe 5 hours. Got 10 hours sleeper and went back to drive tired but it was daytime I can drive daytime a little tired as long as the sun is hitting my face I can keep moving. Do another 450 miles had to stop at a TA to get a hub seal fixed didn't want to risk getting Blitzed by DOT. End up a day late with the load with all the BS I don't blame my trainer if he feels unsafe I'm not going to put it against him.

    SO we finally get to salt lake for the load and get to the terminal go in schedule my upgrade get a room get ALL my luggage out took 2 trips I brought a lot of crap I know anywho start getting comfy brush my teeth. Security knocks says my dm wants to talk to me go there and guess what? The f@$&er wants me not upgrade here instead take ANOTHER hot load to somewhere in Michigan I believe and then drive back to Indiana south holland for my upgrade. He even already contacted the upgrade supervisor to cancel my appointment which I had for next day but he lied and said I was going have to wait until Monday if I stay but anywho he canceled my upgrade appointment and told the central desk to check my out the room ASAP.

    Now I have a hot load to do I only have 5 hrs left on my 70 I'm not getting any hours until 2 days so I'll need a 34 hr reset and my trainer is dead sick with a nasty flu possibly from his tooth abscess. I tried contacting safety all I get is a "we'll contact his supervisor but either way your dm is the one who chooses where you'll be upgrading" which means suck it up and do what he says.

    So anyways..... anyone got some good advice?

    Drive 5 hours, then shut down due to being out of hours. "I'm out of hours and my trainer is too sick to drive."
    Tell your trainer you're not driving any more until he goes to the emergency room. Your trainer has more problems than a tooth absess; he has mental problems.
    Take pictures of all communications on your Qualcom screen concerning this; document everything.
    Don't quit until you are at a terminal so you don't get hit for truck abandonment.
    Find a new job. You'll have a new job in a few hours.

    What are your options?. Run the load and hope you get upgraded in IN?. Pay for your own room and hope the upgrade there comes through on Monday?.

    Personally I would run the load. You could stay put, pay out of pocket and still get a song and dance about why the upgrade isn't going to happen on Monday either.

    Use your 34hr reset to get with some company recruiters and increase your options.

    If it were me though, I wouldn't leave the terminal at Salt Lake with a sick team driver that can't drive. CR England doesn't own you.
    There's several companies that will hire you right now and not even require a new physical. Just do a drug test and hit the road.

    Don't take the load if you don't have the hours. Your trainer also can't legally drive in his condition. Start a record of all communications if you haven't already. Your life, the lives of others, and protecting your CDL are more important than any load. In your communications with your DM make sure you mention that you would have to violate hours of service rules and it would be unsafe to take that load. There are laws protecting you from coercion. Use them if you need to. If they force you to take the load you could always drive until you run out of hours and then refuse to violate HOS rules. There is nothing they can legally do to you if you insist on obeying the law.

    You are under contract to reimburse them for the price of truck driving school. You are free to go to another company and pay them back.

    Of course you can; CR England drivers do it every day. Why do you think they have so many new drivers at orientation every week all over the country? They'll just turn your cdl school bill over to a collection agency; they don't care since they already made a profit off you hauling freight.
    Do some online apps and get moving.

    Here's some advice tell your trainer to get his dam tooth fixed.He should have done that when it first abscessed and no matter what your DM said.Might as well keep kissing your dispatches backside till you finally get upgraded.

    I've never worked under contract before. Can someone tell me, is it possible for the OP to find a clause that puts CRE in breach? If there's any way, then he should feel free to walk, maybe?
