Need some opinions

    If I have a valid CDL in the state of NY but the state of maine has my driving privelages suspended will I get in big trouble if I get pulled over in NY or any state other than Maine? (driving a non cdl vehicle)

    I am working at getting my suspension cleared up in Maine (which is apparently something left over from a dui I got 20 years ago in that state which should have been all cleared up) but until that point I need to know if im risking jail time or big fines or losing my license. I have a spotless driving and criminal record for the past 20 years, the DUI is my only screw up.

    Words cannot describe how pissed off I am at Maine right now. I have been trying to work with them on the phone and its as if none of them have a brain ... they all stare at a computer screen like a bunch of friggin zombies reading off whatever pops up in front of them.

    New York has been perfectly reasonable and easy to work with, I am fine as far as they are concerned, but talking to Maine is ....... :biggrin_25516:

    I'm lost! You should only have one license and it should be from the state in which you are living.

    If your CDL is suspended in one state, its suspended in all states - and that goes for the personal driving privileges as well. If you get caught, it will be treated as driving under a suspended license - and an entire new bag of trouble. If you happen to be driving a CMV, its a whopping big pile of CSA points against you too.

    My license is from New York and it always has been. I was in Maine because I was stationed there in the Navy.

    I got a dui in 1990. I went to court for it, paid my fine, and then the Navy sent me to Iraq for the first gulf war. NY suspended my drivers license because of the dui. A one year automatic suspension and I had to do a alcohol and drug evaluation program before i could get my license back.
    While overseas in the NAVY i did a drug/alcohol course and when I returned home to NY i applied for my license and the state of NY accepted the navy course in lieu of the state course. I got my license back in 1991 ...which I have had ever since that time.
    I have no further tickets of any type and no further incidents involving any sort of alcohol or drugs ... I even quit smoking 5 years ago. I have been pulled over though and the cops have run my license and it's been renewed several times through DMV so I know for a fact my NY license has been good all these years.

    So now its 2o years later and I'm in school to get a cdl and the lady at DMV while I'm getting my permit says she cant give it to me cause Im flagged as suspended in the state of maine ... i had a flag on the NDR which doesnt show up on NY's regular driving abstract apparently.
    So I call Maine and now they want proof I went through a course and want me to have sr-22 insurance for 3 years and pay a 50 dollar reinstatement fee ......:biggrin_25521:
    There aren't any outstanding tickets or warrants for me in Maine, this is purely an administrative issue.

    Im like wtf ... i went through a course or NY would have never given me my license back. I have 20 years I can prove I've had insurance because it's mandatory in NY to have a vehicle registered. SR-22 insurance doesnt even exist in New York state. NY insurance laws are already the equivalent of the sr-22 requirements.

    I guess I'm going to have to get a lawyer to deal with Maine.

    That's the best idea - get an attorney. I think if you google "roadlaw" you'll get ahold of some folks who specialize in this area for CDL holders. This sort of thing is a huge problem in the industry. Someone gets nailed for something minor (or old biz) - you're on the road, so you don't know about it. A missed court date later, the next scale you cross shuts you down for driving with a suspended CDL. Huge fine, major disaster because you're stuck with no transportation, lots of court costs...

    That really sucks though... you're on active duty, take care of biz, and here it is coming around again. You know what they say... BOHICA.

    I had a similiar situation with my DUI back in 1994.. Minnesota driv lic...DUI in Florida... Minnesota revoked my license...was suspended by Florida...had to pay Minnesota to "clear my record"...then had to pay Florida....got my license reissued in Virginia (my ship went into the shipyard there)....filed SR22...then I moved to Arizona in 1995... I switched my policy to Allstate in 1996, Allstate checked my record and couldn't find the DUI so I didn't need the SR22....

    What a pain in the A%& it was...but was my fault for driving drunk!!!!

    most states are what is called reciprocating states meaning if you are suspended or revoked in your home state the other states recognize that suspension or revocation. When I first started in Law Enforcement in 86 there were about 12 states that were not included but that could have changed.
