Negligance of The company which took my sons life

    My Son drove truck for Puget Sound Wood Products, based in Olympia,WA HE was killed when an over loaded 40ft dump truck/trailer rolled over and crushed him. After a lengthly investigation from the DOT, L&I and so on, they found many breaks and cracks in 5 trailer tongues and in the gates. They were shut them down, and ordered to have them fixed and re-inspected. They were fined $2,800.00.. . Now open and up and running again, I was told that there recently was another roll over accident, on a hwy close by where they are working...BUT there has been no information released about the accident. Why?? Are they hiding it??
    SO IF IT WERE ME, I would definately avoid this company...Obviously they just dont care about anyone but themselves, pure greed.

    Take care everyone and please drive safely. If you feel that the equipment your driving is not right, please dont drive it, report it....It could be your last load, like it was my sons.

    I'm sorry to here about your boys life being taken... But the items you mentioned are items that the driver is suppose to look for in his vehicle inspecting. And then it is the driver's responsibility to write the defects up & refuse to drive a unsafe vehicle.

    It sounds like she is talking about the overloaded 40 ft dump that had the safety issues, NOT the one her son was driving.

    In any case, condolences are in order.

    Ms. Bradsmom60 posted a virtual memorial to her son in our Spiritual Garden area a few weeks ago. I just revisited that thread to be sure this was the one I was thinking of.

    Please know, ma'am, I appreciate the pain you must be feeling and the burning ache you feel in looking for answers other than those right in front of you. I can never know the agony you feel right now. Your pain is yours and you are entitled to it. It was a horrible tragedy.

    However. Your son was standing on the running board of a moving vehicle, on bad roads, with no protection from falling off, getting brushed against a tree or bush or the driver losing control of the vehicle and overturning it. OSHA has very specific rules about this very thing: you don't do it. Period. Inspection and repair of the vehicles would not have prevented this. Less weight would not have prevented it. Brand new vehicles running up and down those roads empty would not have prevented it. Perhaps the driver slowing down...may have prevented it.

    But the only sure thing that would have prevented your son's terrible, premature death was a conscious decision he made as a grown man. He chose to stand on the running board of a moving vehicle that, loaded, is not the most stable platform even on the best roads. Had he chosen to either be inside the vehicle, seatbelted into the passenger seat or standing to the side giving direction via radio, he would still be alive. Your son made a grievous error in judgment, chose an extremely unsafe action and cost himself his life. Unfortunately, you, his other family members and his friends are the ones paying the price for his fateful choice.

    I pray you are able to find peace.

    Yes, sorry for your loss. I can only imagine what you are going through.

    From what little I read, there seems to be more the one driver riding outside the truck before. It's an everyone involved mistake.

    Your son shouldn't of road outside the truck like that. He could of said no.

    The driver is the one responsible for the vehicle. He shouldn't of allowed your son to ride outside or encouraged it. He was a young driver and not fully experienced in handling curves.

    The company is responsible because they were aware of this unsafe work practice and done nothing to stop it.

    You can't point the finger at one person as it could of been prevented by anyone of them. I hope you can find some closure.

    I am very sorry for the loss of your son.

    It seems there are a lot of factors that contributed to this accident but the main cause of yours sons death was the fact that he was riding on the running board of the truck that rolled over.

    The driver of the truck shares some of the blame because any responsible truck driver would never allow a person to ride on the running board.

    The fact that the truck was overweight and poorly maintained surely played into the accident but your son would've had a much better chance of surviving the crash had he been inside the truck.

    I too am sorry for your loss but as noted by injun, condo, jellybean and now me this is not a simple case of an unsafe truck but a case of bad judgment by 2 people. Your son and the driver. Not even the "safety issue" of cracks as the cause of the accident and your sons death, but his decision to ride on a running board on a road and not in the seat wearing his seat belt. At most he might have suffered some injury and then you might have been able to get some compensation from the company but because of his actions and then his and the drivers disregard to rules and even OSHA regulations of riding on a moving vehicle running board and not an approved seat.

    I hate to say it but even trying to sue them will prove to be fruitless as their lawyer and insurance company will be quick to point this out unless you can come up with evidence that this company have people ride on the running boards giving instructions to the drivers and you have this on video or in picture.

    Again I'm sorry for your loss.

    Hi Injun, I am in total agreeance of what you said. I guess it really bugs me, is that its happened again, about a week ago. Again, their trucks are so over loaded, it doesnt take much to flip over.
    They were fined 2800.00 for violations with the trailer tongues being bolted permantely so they cant beeak away and the cracks and tears in the trailers from constant years of use.They were shut down a little while until they had all the trailers repaired. Personally I have talked to quite a few people, and asked their opinions.And what I have found out, is that these trucks are for road hauling, not up in the winding, hairpin roads of the mountains, They are too big and do not manouver well like a log truck does. These trucks are NOT FORGIVING!
