If they did not I would not care and really don't as long as the users stay off 28,000 -29.700 mhz. We have talked about this before IF the frequencies around CB ARE NOT being used get them moved over to the CB band .....

This whole issue is for the laws are for everybody but me group. Use of radios is not a right it is a privillege and should be treated as such. Just refects peoples attitude in general.
Want to use 10 meters no problem, get your ticket it is easy now days, no code. And yes I do have my ticket w/extra class. And a commerical license thats was Grandfathered into a NABER cert. But it does not make me exempt from the rules. I have no problem with anything you want to do on 11 meters including power, but keep it on 11 meters.
I can build a COBRA w/ a amp into a import killer for a lot less money and ned up with a louder, cleaner radio than a Connex or a Galaxy. Giving a good radio to a hack to setup for you just means you spent alot of needlessly spent money.

General is still "kinda limited", but at least gives you voice modes on more (and broader) bands, I took my General earlier this year, and IMO if I can pass that test most anyone can, (given some "hitting of the books" [or "Hamtest Online"], of course)!
And then there's the idea that if you "turn in your ticket" the "holier than thou ### holes" have "won"!
IDK about you, but given the choices, IMO the "holier than thou ### holes" can go take a flying leap at a rollin' doughnut!!! -
The idea of civil monetary forfeiture for mere possession of a Galaxy or Connex radio is in itself a crime. To take from someone under the guise of a civil dispensation is a violation of the Bill of Rights. No person shall be deprived of life, liberty, or property without due process of law. For a DOT agent to fine you ten grand for simple possession of a Galaxy is such deprivation. Your ten grand represents your life and your property. The amount of life you lived while lawfully earning it. A ham operator owns a truck and outfits it with His best Galaxy. He is ill and paying you to drive the truck while He is down. Joe driver non-ham gets fined ten grand.
They can play with the wording all they want in desperate attempts to 'legalize' it calling it a 'monetary forfeiture' which is 'civil' as opposed to a fine which can be 'criminal' law. Yet ten grand taken from you is ten grand gone from your life and therefore your time. Taking your time (or property) against your will without due process of law is what we call slavery and doing so without regard to the Bill of Rights is what we call Tyranny. There is no other way to see it. Problem is taking it to the highest courts poses grave danger to liberty. Beginning in the days of Woodrow Wilson there has been a never ending trend by progressives to stack the courts with people who are most happy in their role of ever increasing tyranny. You run the risk of getting a terrible precedent set in stone upon which all further laws will be based.
An offshoot of this concept is the danger which those calling for a constitutional convention represent. Not all if any of the outcomes from such an event would lean in favor of liberty. Most likely today it would all be pushed the other direction.

Ah yes, this is where they get you. Who defines what a 'privilege' is? Who gets to say so. We can say regulating a persons ability to communicate violates their 1st Amendment right of free speech. Being a civil society we can bend a certain amount and agree there needs to be laws to reduce the problems of interference since said interference violates the free speech rights of others. Thus radio can be regulated to reduce interference in a logical way to protect the rights of others. However as a medium which conveys peoples words and thoughts the concept of free speech comes into play meaning it is a right to communicate and can never be called a privilege. Who establishes these controls the FCC? Am I the only one who notices you cannot listen to talk FM because all the stations are jammed together leaving vast stretches of 88 to 108 MHZ empty. Just how well are they doing their jobs and what agendas come into play here?
A bureaucrat unelected passing regulations which entail criminal prosecution? They banned over the counter inhalers. So next year poor people who cannot breathe have to pay a Dr visit fee and fork over $60 for a prescription inhaler, whereas today they stop by Wallmart and pay $19 without a Dr visit fee. All in the name of saving the Ozone, itself a poison gas. No studies were done to show the harm asthma sufferers as a group were doing to the Ozone layer, and zero consideration is given to the life liberty and property of the poor asthma sufferers. Worse still, the prescription inhalers use the same #### Ozone depleting CFC's, meaning the only result is a poor person is now paying over a hundred bucks for a single inhaler instead of $19. Who gets all this extra money and how much harm is being done to society as a whole. Save the planet - kill all the people. The green fanatics really do think this way! All is corruption and nothing is more corrupt than bureaucrats who appointed themselves God.

The problem here is whether or not you can pose a danger to the public safety. In effect if you cause a wreck you are taking away from the rights of others. So your case is not so valid, especially the last few words. I seldom actually see common sense applied in traffic anymore. Needing transportation to pursue life liberty and happiness also shows driving must be a right not a privilege. Therefore the entire subject is a gray area which has been subject to controversy for decades. Especially when it comes to states rights VS federal rights.

True, but there are people out there who are not hacks if you look long enough to find them and stick with them so they do not vanish due to an ever decreasing economy. -

Some of the Maryland State Police are the DOT officers. They issue the fines at the scales or roadside inspections for Export radios. They ask if you have a License for that radio. And if you can't show it they hit you with the fines. They issued a friend of mine a ticket for having a Ham radio without asking for a Ham License. Just his drivers license. Only to find out after writing it that he's a Ham. That's the reason I first got my License. Because they see Drivers as a cash cow. And it's getting worst.K7DFA Thanks this. -
I had to take tests for my drivers liscenses to proove that I will not kill anyone else while operating any of these vehicles. HUGE difference. I do not see were operating a radio is going to kill someone or even injure someone.
But then when I am in the truck, I am usually loaded in excess of 96,000 lbs gross weight & up to 105,500 during harvest and winter permit times. It is only right for me to have a special liscense to operate said vehicle.
The motorcycle liscense is there to prove I can propperly operate my bike without becoming a danger to others or cause accidents.
About the only harm my radio ever did was when I have the mic hanging at easy reach from the ceiling in the truck and it swings and smacks me on the side of the head. I shortened up the cord on the gear keeper so that won't happen again.K7DFA Thanks this. -
I can see enforcing complaints where interference or other problems are being caused by illegal operation of a station. Especially where they have actually measured your signal. They step over the line issuing citations for possession of electronic gear without evidence of any illegal activity. This is because they are now in the area of 'thought crimes'. They think you must have used it therefore you are a criminal merely because you have it. Where does it end. If I own a gun am I therefore a bank robber? Or just a law abiding citizen who believes in self defense. If they are allowed to do this then there is no line to draw on any subject anywhere in society.

Florida UNLIKE some places it is LEGAL to have a gun .... Our law allows you to shoot anyone who invades your home. When I lived in another state you could not OWN a gun they did not care what the Constitution said OWNING that gun was the same as using it to rob a Bank ... at least they thought so .... which is why i live here and OWN a gun ......
