I don't know if you saw where I said I stand corrected. I did not realize with the new changes that you could take a 2 or 3 hour break 1st. What I meant was and I'm only assuming that you are a company driverr, and I don't mean that as an insult. But if you have the play a $500 late fee out of your pocket. I think that would change your outlook. I also wish they would have done something about the shippers and receivers holding up trucks so long at the facility. I've been driving 32 years know how to make hours of service work for me however there are some situations where that isn't always possibleLast edited: Jun 11, 2020

HOS isn't forcing. Americold and many others are. If you have bad weather or traffic, you tired and you can't stop because appointment time. If you late 15 minutes they will charge you $250.00 or reschedule 3 -4 days later. No, you can't be here earlier. No, we don't have control over the lumpers. No, you can't stay here after unloaded.

Which I agree with. My point is blaming HOS for driving tired is not only pointless, it's counterproductive. Blaming poor shipping practices, poor contracts, etc might be able to get the problem fixed. Blaming HOS won't.deathB4decaf, nredfor88 and Snailexpress Thank this.

§392.3 Ill or fatigued operator.
No driver shall operate a commercial motor vehicle, and a motor carrier shall not require or permit a driver to operate a commercial motor vehicle, while the driver's ability or alertness is so impaired, or so likely to become impaired, through fatigue, illness, or any other cause, as to make it unsafe for him/her to begin or continue to operate the commercial motor vehicle.
Edit: So yes, not technically HOS related as HOS is part 395, but close enough. Point is running tired is already against the law. Fixing the reason that causes one to run tired like the above example of Americold is what is needed. Pointing to HOS only makes fixing it harder as it's already illegal to run tired. -
Basically HOS says the MAX time you can drive/work. Common sense tells you when you should rest/sleep. Based on your fatigue.

But if you are forced to take 10 hour break when you are not tired and instead have to wait 10 hours before you can get to delivery how is that safe?

No, your wanting to make more money (or not loose as much) is all that's making you run tired.And to be honest, statistics have shown that you wanting to make more money (relaxed HOS) causes more wrecks.
