You CAN get caught in an audit too . Log falsification is a criminal offense . DOT Office of Inspector General has prosecuted drivers and company owners

Very true, but you'll be fine in an audit if your editing actions are accurate. I'm always off duty while loading, and Maverick gave us that little card that says its okay to be off duty while loading, so I know I'm in the clear.

However, I don't know how that works on the flatbed side, since you guys are actually participating in the loading process as opposed to us TCD guys who just sit and wait.

If you're required to be on duty when loading, then definitely don't go back and change your logs to say that you were off duty. However, if its okay and legal to be off duty, you can edit them to get that time back while noting that it's just a log fix.

REALLLLLY???????? I HAD NO IDEA!!!!! LMAO.... Seriously Dude. You must not have EVER read any of my posts if you even think that I would encourage anyone to do anything with even the slightest bit of untruthfulness or illegality. The fact remains, HE STATED THAT HE HAD MADE AN ERROR ON HIS LOGS THAT CAUSED HIM TO HAVE THE SITUATION. Please go back and RE-READ the posts. SO- IN REVIEW- You can edit your logs. And! Apparently, you can misread posts on here and make people think that you are more interested in preaching than advising.

So you think this was an "error" that is o.k. to edit

Good luck to you if you "edit" similar "errors" when you need more hours .

If it is what happened then YES. If it IS NOT what happened, then NO. My original post regarding this was You can edit your logs. If he needed to correct an error on his logs then he should do so. If he -you- or anyone- chooses to falsify their logs, that is not something that I condone. And I appreciate your goodwill. You obviously have his best interests in mind by your postings, right? If so, then I officially apologize for mis-interpreting you.

No apology needed but appreciated . QC drivers cannot edit logs . They have to e-mail the terminal . The Blackberrys at the terminal I worked for were very sensitive and any movement could cause an unknown change of duty status . It was best to switch to another phone application when off duty .
My problem was this driver was his deciding he should have logged a 30 minute break before leaving the shipper . That sounded suspicious .

Well, I would say that THAT occurrence is probably not uncommon. Afterall, I know personally, after I have been out on the trailer on a hot day say- at the Tin Mill or AK Middletown- bustin' my rear to get a coil tied down and tarped, that I usually have to change clothes, towel off, drink a gallon of water LOL, go check out and send in my Leaving Shipper call- all which could conceivably be about 30 minutes, well, right there could be the period of time in which the OP could have been speaking. Us flatbedders have times such as I just described.

Have a quick question. Does the 30 minute break have to be logged as off duty or can it be either SB or off-duty? Haven't had to take one yet. And also, can be done any time before drive your 8 hours? Like within the first 2-3 hours?

Line 1 or line 2 is fine.

Can be taken any time. However, if you take it after 2 hours you may need to take another 30 minute break later on in the day. If at anytime you have worked 8 hours or longer without a break of at least 30 minutes you cannot drive.

Your answer points out an interesting wrinkle in the 30-Min Break Rule. The break is required "if more than 8 consecutive hours have passed since the last off-duty (or sleeper-berth) period of at least half an hour."

And in the spirit of the gift that keeps on giving, since there is a duty status change, we get to log an additional cargo/securement inspection. Yippie!
