New to O/O - How to Handle Detention Pay?

    We are finishing our 3rd week operating under own own authority. First 2 weeks were great. This week, we have had 2 major delays - both loads not available to be picked up until the next day, the day after the scheduled pick up date. Both times we were not notified until we got to the shipper, and had already done deadhead miles etc..so grabbing another load would not have been ideal at that point.

    To date, we have hauled 15 loads. Only one load confirmation sheet has had ANY provision for "truck ordered, not used = $125", and none have said anything about detention time. Should we be negotiating this with the broker on every load, insisting there be a provision for this on every confirmation sheet? or do we hand write it on the sheet before sending back?

    Please let us know how you experienced o/o handle this. Thanks for any help.

    Anything you add to the rate confirmation has no legal standing and cannot be enforced. The broker needs to revise it and re-fax it to you.

    Collecting detention in this situation is for the most part a hit and miss proposition. In the future, you need to call the broker, as soon as you know you will be delayed, and agree on a fair amount for the delay. Usually $60 an hour after 2 hours, with an 8 hour max per day. If they refuse to pay it then be prepared to cancel the truck.
