What up guys. I started delivering soda locally in my area. No town is more than 60 miles away from the place I report to work (a parking lot where the truck is parked).
Company home office is located 250 miles away. My paperwork lists my town as the home Depot (again a parking lot), or the place I report to begin work.
The company also has me fill out a paper log book for there records, however I am paid hourly. My question is when I hit the port of entry can I legally tell them I punch a time clock and just show them a time sheet? Or since the company requires the log book I legally have to show it to the DOT if requested.
With a logbook exemption I'm still required to follow the 10/11/14 rules correct? At least that's what I understood when reading the FMCSA exemption page.
I am not trying to hide anything, nor run illegally just trying to better understand the rules.
The company trainer is NOT very helpful and has even gone as far to tell me I'm REQUIRED to take a weekly 34 under the new hos rules. As soon as I heard that I was immediately thinking no more hours of service advice from him haha.

From what I understand, DOT does not require you to log since your remaining within 150 miles of home port. You are not required to keep a log, but you are still required to follow hours of service including, 8, 11, 34 and 70 hour rules. If your company requiers you to log, legally you could probably just keep the book int he back of the truck and never show to DOT. I would recommend keeping it accurate and offering to DOT if they request to avoid any problems. Although not technically required, there are some gray areas up to interpretation and it doesn't make sense to piss off a dot cop.

yes you have to fill out a paper log log book. even though your reporting to the customer for work. the nearest terminal is 250 miles a way. so that puts the work out side of the 75 mile radius allowed by the dot. so you have to show a half hour brake every 8 hours of on duty status. you also have to use 70 hour 8 day recapp rule. you also have to use the 11/14 rule. now if they had an office at the home depot you are reporting to. then you would be under a different part of the rules.

You meet the definition of a local short haul driver.
No log is needed unless your company tells you to log as in they have other drivers that go outside the circle. No time card is needed in your possession. All you have to tell the DOT is you are a local driver that stays within 100 miles of your starting point. If the DOT wants to see time documentation like a time card they will request it from the company and the company has to comply. This is one situation the driver is relieved from any documentation except bills, registration, insurance card, a CDL and medical card.
I take it you log so that has to be presented if asked but it doesn't take away from that you are a local driver. You don't even have to go to line 4. All work/driving goes on line 3 for a local driver. You might write down in remarks... Short Haul within 100 miles of starting location. That will eliminate any confusion.road_runner Thanks this. -
One question on this, where do you get your soda at? Did the company make up a fictitious starting point to keep everything inside the circle as in the plant is on one end of the circle and your last customer is on the other end of a circle.
In that case that might be a problem as they are stretching the truth. Do you physically park the truck at Home Depot or at home? -
you shouldn't have to list your companies address as where you report if your company agrees that you report at your local address. I had to deal with that a few years ago and since I didn't report to the office that was 125 miles away that allowed me to report as my local address.

You May or May Not Be Required to Keep a Log Book But since your company requires you to fill one out for time purpose.Why not just use it in case you get stopped by the DOT. You need to ask your company these questions.I'm a local driver I go within a 90 mile radius and I have to log everything.It's your companies degression whether you need to carry a log book.So why don't you believe your trainer about the 34 hr rule?
