This is not legal any employees at any business must have an available restroom.

This would be an OSHA violation and you would need to call and make a claim with OSHA.

Response: OSHA's sanitation standard that addresses restrooms for general industry may be found in Title 29 of the Code of Federal Regulations, Part 1910, Section 141

Not allowing you to use the bathroom could violate OSHA laws in every state.

... The city's health and plumbing inspector, after conferring with the state's chief plumbing inspector, notified store employees and the supervisor that they were wrong in denying the woman access to the bathroom. City and state codes require that customers, patrons and visitors to such public businesses must be allowed to use toilet facilities. ... ... the state inspector, agreed, listing a series of state codes dating back to the late 1970s in addition to the 2000 edition of the International Plumbing Code, which the city adopted. ... ... a store that violates codes can be found guilty of a misdemeanor charge ...

    One other thing to add.
ARA's 403.5.1 IPC CODE PROPOSAL HAS BEEN APPROVED
This change has been published in the 2009 International Plumbing Codes.

This looks to be a national building toilet code. It was passed in 2009.

I am sure not many know about it.

    Good luck.

A truck driver is not considered an employee of a company that they are delivering or shipping from.

Osha only deals when the driver is on the dock.

The International Plumbing Code states patrons and visitors must be aloud to use their facilities.

I am an owner of a building in the state of Illinois. I have employees and they are allowed to use facilities. My business does not allow for people to have access to the building. Sorry, you are in the dark here.

    My business is a bank.

I am not a trucker yet, but I will add my 2 cents. I have seen many public restrooms that were a complete mess with "you know what" all over the floor and all kinds of trash every where and I am sure that there had not been any truckers in there. This is not just a trucker issue, it is an issue about people who don't give a $&#* about other people.

RoadMedic, I agree with your above statement. Companies have truckers bringing things to their companies therefore the trucker is a patron or visitor. I believe a lawyer could have a field day with a discrimination claim on a company who uses truckers to deliver their goods then denies them to be allowed to use their bathroom. Your business is not the kind that trucks back up to.

I don't believe any trucker has the time to contact a lawyer over this, but if they did I believe they would win if the company is the type that has trucks docking all day. Truckers are visitors and patrons.

To right out single out truck drivers and not allow them to use your bathroom is discrimination! That is like saying because you are a baseball player you can't use a companies bathroom.

I am no lawyer, but I was required to take business law in college and I believe nobody has ever challenged these companies. If they did the truckers would win! How could you have a truck driver deliver to your dock and not allow them to use your bathroom?

I do know for a fact if a trucker has a disability like diabetes you better let him use your bathroom or he does have the right to sue. I know that as a fact! The disabilities Act does have such provisions in it.
