If registered weight is over 26 (40k) you need a cdl….

Is this thing a toy or is actually used in commerce?

Your info provided creates a lot of confusion.
If the vehicle has a cab card and the registered weight for the truck is 40k you need a CDL to drive it.
Bobtail or with a trailer. That's very simple now.
EX: My Volvo has a 18200 lbs weight according to the sticker.
But the cab card specifies 52000 lbs as GVWR. 3 axles tractor-trailer.
I need a CDL to drive it bobtail.
If I'll decide to use it as a recreational vehicle, I need a different plate,
no IFTA/IRP plate, an NTL insurance and a decal 'NOT FOR HIRE' on both sides of the cab.
A non-CDL license with air brake endorsement will be fine to drive it.
    Are we getting somewhere, now?

Nope. All the requirements are for weight ratings or actual weight, not registered weight.
