Not at Fault accident question

    You won t be punished for this accident. He hit you. I would get a copy of the police report to have for your records. This accident will go on your record 1 or 2 ways

    1. If the other driver s car could be driven from the scene other than his right rear tire being blown out, it will show on your record as a non-preventable accident meaning you re not at fault

    2. If the other car was towed due to damage, it will show up as a DOT recordable, non-preventable because a tow was involved and its a law to report it regardless of who s at fault

    Dang.. sorry that happened, glad you handled it very well... something like could and has caused drivers to react and end up jack knifing or swerving themselves into a mess... so, great job handling it properly. ..

    Also, you did the right thing bh stopping.. as stated fuzzeymateo.. you are required by law to stop... there was a driver at my company who was on a time crunch to get to the shippers on time... a care merging merged right into him.... he didnt stop... well, it got real ugly for him... the passenger in the car got his trailer number, which was matched to his truck.. he got pulled in at a weigh station and arrested.... but, what made it even worse.. was the driver clamed he merged in to him.. and in the he said they said he did t have much credibility considering he left the scene.. which made him look quilty.... he ended up being terminated and in a heap of legal trouble...

    Now, I am sure there will be some post to follow with tales of how a car hit them a d they did t stop and nothing ever came of it.. but, what a crazy risk to take....

    Again glad you're okay and handled it properly, and thanks for sharing as it is good for us all to remember that we can all find ourselves in that position...

    yeah that car was totaled and towed away.

    my truck was just fine, mainly only some marks on my rim and metal foot step.. that's it.
    I took pictures of the damage to both vehicles, always remember to do so.
    In my case the pictures prove who's at fault, not what either of us say.

    All I know if that my one year experience isn't much if I have a lot of "stuff" recorded on my record.
    Not that I do but this doesn't help.

    I don't know what to tell you other than my experience with a not at fault accident. I was hit by some broad on the freeway more than a year ago and it hasn't shown up on my MVR. No ticket, no injuries. I think she was on the phone when she hit me because when the dust had cleared her cellphone was sitting in the number 3 lane of a 5 lane highway.

    If a driver strings up a large sequence of 'not at fault' accidents over a short period, that would raise the question of "Does this driver drive in a defensive manner?". Sure, a 'not at fault or two' shouldn't be anything, but someone racking up a half dozen of them in a year or two would certainly raise questions. I wouldn't worry about this one - just check the crash report, keep a copy, keep calm and drive on!

    If no police report was filed, then nothing will go on your MVR and/or your CSA/PSP. The carrier MIGHT put the non-preventable on your DAC, but that is highly unlikely given that the damage is minimal.

    Wait 90 days and check your MVR, PSP, and DAC reports. If the accident isnt on either, then you can forget about it.

    Cell phone and accident?

    Last winter in a snow and icy morning, I had a guy spin out 360(twice)right in front of me..each time he spun the circle I could see he was on the phone..as he spun 360 into the ditch and the snow was flying I could see when he finally stopped and climbed out he was still on the phone!!!
    Gotta give him credit..i would have hung up while spinning round/round on the freeway in a snowstorm..

    You had to stop. Leaving the scene of an accident is a serious thing. Get a copy of the accident reports and keep them. It may go one your CSA as an accident and the CSA they does not indicate whose fault it was. As far as your DAC (now HireRight), that depends on what you company puts on there when you leave the company. A lot of companies only indicate wether or not they would rehire you. Others can be pretty chicken s--t about it. You can get a free Dac report once a year (www.hireright.com). If your accident is on there you can try to get it removed or they will let you put your explaination on there.

    Some estimate suicides by deliberate motor vehicle crash runs as high as 5% of fatal crashes. We can reasonably assume that number is not zero.

    Trucking has been around a long time. The industry is as aware and forgiving of crashes that are not driver preventable as they are of tickets issued for no offense.

    Don't sweat it.

    Its really crummy how 4 wheelers can get away with bad behavior,but the big trucks always get punished.
    I have a friend that was ran into at the end of a construction zone. The lanes were reduced from 4 to 2.
    Some fine member of society tried to force his way in,and instead of hitting cones,hit my buddies trailer.
    He refused to stop,and flipped my buddy off,and kept going.The Toyota had damage,and he knew he screewd
    the pooch.
    Its disgusting,because a truck driver would have been ran down,and arrested if the situation was reversed.
