Let's say you have several years experience as a driver. Then you go to work for a different company and only stay there a month. You leave because it just isn't working out. And if you don't want to put that on your resume to blemish your otherwise perfect track record of employment, does this violate any FMCSA or DOT regulations? Are you required by law to disclose that employer just because it was a safety sensitive position ?

It's cause for termination by most employers for falsification of information on your application. Usually says so in the fine print at the bottom where you sign it. I believe it won't mess up your record if the job didn't work out for whatever reason, but it can be a deal breaker if you don't disclose it and they find out later.

List all Previous Employers for the last ten years
By signing this I acknowledge that the information contained is true to the best of my knowledge..
Intentionally not.listing a previous employer violates both of those. -

I worked for a company technically for one day and quit when I discovered they were going to pay me via 1099 form or cash. Still shows up my driver history thing and had a company call me out on it once after filling out an app. Told them I never received ANY money from that company, but they didn't seem to care and acted as though I was hiding something. Needless to say, I didn't get the job

Hmm. Thanks for your input guys. It wouldn't be my intention to falsify an application, but I'm having a legal dispute involving a lawyer with these people, and I didn't intend on listing them on any future application for that reason alone.

Things sure have changed. Years ago, I'd quit one job and be driving a different truck later that week. I think once, I had 3 jobs in a month. It was no big deal. When going to a new job, I'd just leave the crappy jobs off the list, we'd go for a "test drive", in 5 minutes the new boss could clearly see I knew what I was doing, and I'd be on my way that afternoon. ( I'd keep all my trucking stuff with me when applying, as I knew I could be on my way that day) Not anymore, and if you have a legal issue with a past employer, I'd think alarms and whistles go off when you apply somewhere else. It's a darn shame too, as so many companies are missing out on hiring good drivers because of the garbage rules we have today. I think it's one of the main reasons we have such a driver dilemma in this country today. Good luck, pal.

Anymore in this industry employers know people jump around for whatever reason.Showing only a month with a company doesn't really throw up a red flag. What does is when they run your background and that job is not listed.They figure you left it off for a reason.They will run a DAC report and if they see it you may get by with it but it's better to just list it and go on with your life.

If they don't report to DAC and nothing shows up in a psp report don't list them..
If the company you are applying to asks about the gap tell them you took some time off..
All I ever tell them is "was haul'n cows off the books can't list it".....Which is somewhat true in my case...rocknroll81, roadmap65, 201 and 1 other person Thank this. -
If you do not provide a full 10 employment history honestly listing all employers you are in violation of FMCSA rule 383.35.
