There are so many instances that this would be life threatening to say the least.
In the fire truck, we have to depend on the radio, if down, or private, we use our cell phones. This is especially important during calls where we want no information broadcast over the air. I will let you try to imagine the type of calls and the reaction if we have no contact.
In the ambulance, we contact while moving for treatment on the patient in route to the hospital.
This says nothing about the team drivers who are on their break for 10 hours. What would happen? No calls, no internet, no texting?

OK, so we have our new law/rule handed down by our overlords, now for another question.
Let's say one has (and I do) their phone synched up with their Gmail, Facebook, Ebay or whatever else. The phone does it's little updates all on it's own. Can these little handy apps cause one trouble? Can they tell the difference between the phone initiating it's own update from one that you did manually? Is this easily checked in your carrier records?
What I am getting at is, if you have an accident and they check your phone and it shows data transmission (if that is possible, I don't know) around the time of the accident, are you screwed?

You'll be fine, data transfer for an automatic update is going to register differently than texting or making a call.

It's not going to register any different than searching the internet. What's funny is I have 2 phones and a wireless data MI-FI card. One phone connects to the MI-FI so the phone would show no data transmissions, also with the new IO5 operating system of an Iphone any "text" messages to another IO5 device is sent over the net in the form of an Imessage so no "text message" is logged to the phone provider.
So technically all my "text messages" would just show as normal phone updates such as mail.
This is just for informational purposes only, I even took the mirrors off my truck so my eyes never leave the road in front of me. It just wouldn't be safe.

Have you tried duct taping your hands to the wheel? I hear that helps in maintaining control of the vehicle at all times.

True, it must have been all bubblegum and rainbows in the days before cell phones. I mean to drive in a time when there were no such things as car accidents!

It's just like guns, no one ever died and there was zero violence before the gun was invented!

After digging thru the ruling a couple times, its nice to know that not paying attention to the road due to browsing the web on your non "mobile telephone" ipad/droid tablet would not violate the rule.

Do they really think that its the holding of the phone that distracts people? Its the fact that your having a conversation. Your just as distracted while having a conversation with a headset as you would be holding the phone
