Tell me what line of work,is there out here where you get done with your employer or contract and are prevented from travelling home? What makes truckers exempt from this and virtually prisoners to their own trucks? I mean maybe this is something that will have to be argued by lawyers at some point or even further clarified with an adjustment to the current reg. I just don't think it reasonable to keep someone from going home on personal, private,non work related reasons. Everybody I know that works goes home when they're done. Why is it different for truckers? The fact there are exemptions to e log and even a need for PC prove exactly what an unsensible a mess these regulations are.

 

When I leased on to Mercer in 2011 they told us in orientation that if we were on the west coast and lived anywhere in the country and just wanted to go home that we could use PC to do so. The regs don’t say that you can’t. They also said if we were to get fined and shut down for it that they (Mercer) would fight it for us.

I agree that I think it’s ok to do. I just don’t think it’s spelled out well enough. And there’s going to be enforcement issues with it as DOT officers are going to see it differently as the one in MN did.

 

7. Authorized use of a CMV to travel home after working at an offsite location.

I guess that could be taken a couple of ways. I see it as saying if you are working out at a job site moving material or equipment (for instance) and use all your hours up, then you could PC to get home.

 

As PC was explained to me by Oregon DOT your starting point and ending point must be the same. Bobtail only. Can't be dispatched with a load PLAN.

Also PC can be turned on and off by your carrier with limitations such as how far you can commute under PC.
Under ELD PC works the same except the Govt requires PC to be specifically highlighted with dotted line a color band something that makes it stand out so the DOT can audit and compare easily with FMCSA rules.

Also keep in mind an ELD and AOBRD are 2 different devices not sure if some are aware of this. 1 collects more data for audit purposes. ELD mandate is Dec 2019. for those on AORBD.

So if you get pulled over its best to tell the officer which device you are currently running under can make a difference.

 

No where does it say it has to be bobtail only. It says unladen. That means no load on the trailer.

 

That was the old PC regs. You must have missed the big news flash a few weeks ago PC regs were updated. You can now be loaded and use PC but only to move the truck to the nearest safe parking spot.

 

I'd never even heard of PC before EOBR was mandated. Didn't even know you could use it with paper logs.

 

Ya pc has been around basically for ever. Long before elogs.

 

The problem is the Feds have worded the regulation very vaguely. It's up for interpretation by the inspecting officer. One may agree on your particular circumstance while another officer may see it in the opposite light. I'm certain it's written in such a way purposely to cherry pick dollars from the 18 wheeled money trees when the need for State revenue arises.

 

I used it Thursday night, the PC. I was held up all day, guys not showing up for work etc... I ran out of hours loading down in Tecumseh MI. I went to line 5, off duty driving and made my way an hour up the road to Dexter MI and the Pilot where I parked. Nine hours later I was doing my pretrip and on my way to Flint for my three hour late delivery.

And when I say line 5, the ELD records the off duty driving status in line one, where you are normally off duty. Line 5 is an oil field option that we had. But still kind of works the same.
