O/Op required to drug test themselves?

    In addition to random testing, your husband must also meet the other criteria as well i.e. post accident etc. After you read my above post showing the rule where you husband must be tested, you need to read the rest of part 382. Since he meets the requirements of part 382.103 he must meet all the requirements and mandates of part 382. In this case the word "part" means part 382.

    The rule to which AADAT is referring is 382.603 (as an employer). As an independent contractor working under your own authority and if you get your own loads (if you dispatch yourself) you legally employ yourself. If you do not meet this criteria then AADAT is incorrect. In this case (if you do not employ yourself) the rule would apply to the people who dispatch you.
