Oct 23 and new elog users are going nuts lol

    I'm pretty sure the FMCSA has never really layed down rules related to "personal conveyance". I suspect what happened is, certain large carriers went to them asking for help in dealing with real-world situations [especially related to leased operators] and they refused, so they went to Omnitracs and told them to create a "line 5 option" and they'd decide how they would insure it would not be abused. And it just stuck and got passed around through the grapevine.

    This would explain why so few carriers provide this option. But some state auditors probably recognize this as a sensible option for many carriers as long as it's not abused, so it's "allowed" by some

    Link - What is personal conveyance?

    Using the information that is in the interpretation above and in the definition of “on duty” and the corresponding interpretation found in Section §395.2, the following conditions of personal conveyance can be extrapolated.

    • The vehicle must be unladen.
    • Movement is of a “short” distance solely for personal use.
    • The driver is relieved from work and all responsibility for performing work.
    • The driver is relieved of all duty and responsibility for the care and custody of the vehicle, its accessories, and any cargo or passengers it may be carrying.
    • The driver must be at liberty to pursue activities of his/her own choosing.
    • No work should be done until the driver is ready to return to duty.

    Note - If on ELD's you are still required to have these.

    ELD Checklist for Drivers

    Mandatory Items are:

    • ELD User’s Manual
    • Instruction sheet for transferring HOS records to safety officials
    • Instruction sheet on reporting ELD malfunctions & recordkeeping procedures during ELD malfunctions
    • A supply of paper tracking forms (grid graphs) for at least 8 days, in case of ELD malfunction

    So what's considered common sense? As I stated above, my company will have me drop my trailer in Sharonville and then bobtail home 108 miles one way, then come Monday morning, i either get a dispatch from home, or ill bobtail back to my yard, another 108 miles.

    Don't shoot the messenger, but my understanding is that while there is no set mileage, you getting a "dispatch" at home could be construed as no longer relieved of all duties???

    I think to be truly PC, you would HAVE to BT back to your yard, THEN get your dispatch, and I may very well be wrong on this.

    You forgot the doctor's rx for Xanax to deal with all the anxiety and stress to be encountered in the first 30 days. Gonna be fun for us seasoned eLog drivers listening to those new to the eLog game gripe and moan all day.

    Correct, the guidance has stated that a driver can be dispatched from home, and if so then the driver must go on duty.

    Correct. If the company allows PC home 108 miles then that is the company. But if dispatched from home then once they leave home they are on line 3 for driving
